An American judge ruled that being parodied is part of the job after Barbie's maker MATTEL filed a lawsuit against MCA RECORDS, contending that the Aqua's song BARBIE GIRL infringed copyright and sullied the doll's image. The Scandinavians stormed the charts in 1997 with the song, in which lead singer LENE NYSTROM, portraying Barbie, refers to herself as a "blonde bimbo". She is also enticed to "go party" by male singer RENE DIF, representing KEN, Barbie's steady boyfriend. But Judge ALEX KOZINSKI said the song was protected by the right to free speech in the US constitution because it was a parody and a social commentary. July 25, 2002, 8 PM, PDT - (FTW) In a session lasting until 2 A.M., the House of Representatives today passed an amendment to the 2002 Intelligence Authorization creating establishment of a "blue ribbon" Bill (HR 2883) that would require the independent commission to investigate the attacks of last September 11th. The amendment, introduced by Indiana Democrat Tim Roemer, passed by a vote of 219 to 188. 25 of those voting in favor were Republicans. But the passage of this amendment is a far cry from seeing the commission signed into existence. A separate Senate bill (S 1867) sponsored by Arizona Senator John McCain ® and Joe Lieberman (D) has been voted out of the Senate Governmental Affairs Committee as a separate piece of legislation but has not been voted on by the full Senate. There are differences between the two measures but the House version has the best chance of being acted on by Congress in the near future. Before an intelligence-funding bill goes to President Bush for signature, the Senate and House versions must be reconciled in the Conference Committee and there the Senate will either accept or reject the Roemer/Smith amendments. Of the two versions, the House amendment offers some protection against political cover-up because of an amendment offered by Rep. Christopher Smith (R-NJ) that would require inclusion of victim family members on the commission. Historically, independent commissions looking into events from the JFKAssassination, to the Iran-Contra scandal, to the crash of TWA 800have failed to publicly acknowledge facts that were later disclosed and or admitted to in government documents. With the legitimacy of the Bush Administration, and perhaps the entire government, at stake - expectations of miraculous revelations from such a commission are likely overoptimistic. In her book "Kiss The Boys Goodbye" (Penguin, 1990), former 60 MINUTES producer Monika Jensen-Stevenson documented the heartbreaking infiltration of the Vietnam POW movement by government and intelligence operatives to cover-up evidence that large numbers of U.S. POWs and MIAs had been abandoned in Southeast Asia. What began as a unified and committed movement ultimately disintegrated into splintered and disorganized factions that often fought each other harder than they fought the government. Though we know they were left behind, no POWs were ever re patriated. The stakes with 9/11 are much higher and the administration knows this. Sources tell FTW that the most effective way to ensure passage of the House version of the intelligence bill is for activists to contact members of the United States and encourage them to adopt the Roemer and Smith amendments. Additional contacts can be made directly to House-Senate conference committee members from the U.S. Senate. A Senate vote on the intelligence appropriations act is unlikely before Summer recess which starts next Monday. The Congress will reconvene on Tuesday, September 3rd and action on the bill is expected shortly thereafter. If the Senate adopts the two amendments and sends the bill to the White House, there is still the possibility that President Bush will veto it. Silencing a Palestinian Moderate By Anthony Lewis - New York Times | Opinion - Saturday, 13 July, 2002 Why would Israel shut down the office of the leading Palestinian moderate? Many asked that question when Israeli police acted this week against Sari Nusseibeh, president of Al Quds University and the Palestine Liberation Organization's designated representative in Jerusalem. They carted off his files and changed the lock on the door. Mr. Nusseibeh has been a voice for peace over many years. In 1988, before a two-state solution was policy on either side, he told me that Palestinians should say to Israel: "We don't want to destroy your state, but we want our own state alongside." Last fall he said Palestinians should give up their claim of a right to return to homes in Israel. In short, he is the perfect example of the new kind of leadership, peaceful and pragmatic, that Prime Minister Ariel Sharon of Israel and President Bush have said the Palestinians must have before there can be political negotiations on an end to the conflict. Why target him? The answer is that important elements in the Israeli government do not want a real two-state solution and do not want political negotiations with a reformed Palestinian leadership. They prefer the present situation: the West Bank occupied or tightly controlled by Israel, with an increasing number of Jewish settlers. The last thing they want is a respected Palestinian interlocutor. The police raid was ordered by Uzi Landau, minister of public security in the Sharon government. A hard-line member of the Likud Party, Mr. Landau opposed the Oslo agreement, with its call for gradual Israeli withdrawal from occupied territory in favor of Palestinian control. Jerusalem is a second part of the disinclination to negotiate. Mr. Landau and others on the political right oppose giving up any part of Israel's claimed sovereignty over greater Jerusalem. But Palestinians say they must have the capital of their state in East Jerusalem, which is overwhelmingly Palestinian in population. No Palestinian leader would, or politically could, accept a final agreement without at least a small, symbolic Palestinian piece of Jerusalem. The previous Israeli prime minister, Ehud Barak, recognized as much at Camp David two years ago when he offered the Palestinians sovereignty over parts of East Jerusalem. Israelis like Mr. Landau who say they will refuse to negotiate about Jerusalem are in effect saying there will be no negotiations. Mr. Landau said Mr. Nusseibeh's role as Jerusalem representative of the P.L.O. was an effort to "undermine Israeli sovereignty in Jerusalem." Mr. Nusseibeh has no power there, but he is visible. And he comes from a family that has been prominent in Jerusalem for centuries. The Nusseibehs hold the keys to the Church of the Holy Sepulchre, given to them by the quarreling Christian sects because they could not agree on which should have them. Where does Prime Minister Sharon stand on these questions? He did not tell Mr. Landau to move against Sari Nusseibeh. But given the positions he has stated frequently, there is no reason to think that he opposed the police raid or disagreed with its objectives. Mr. Sharon has made clear that his idea of a "Palestinian state," if he ever agreed to its creation, is very different from the viable state that international negotiators have had in mind. He envisages islands of Palestinian territory, not contiguous, surrounded by Israeli settlements, highways and military units. It would not include any part of Jerusalem. Mr. Sharon and Mr. Landau did not worry about United States reaction to the Nusseibeh raid. They believe they have carte blanche from President Bush to act as they wish against the Palestinians. Mr. Bush's recent speech really withdrew the United States from an active role for the moment. So Israel felt no sting from a White House statement that the Nusseibeh raid was "troubling." All this must fascinate Sari Nusseibeh, who is really not a politician but an Oxford-educated philosopher. This spring he, a Muslim, used a Christian metaphor in a comment to David Remnick of The New Yorker. "The Palestinians," he said, "have to resurrect the spirit of Christ to absorb the sense of pain and insult they feel and control it, and not let it determine the way they act toward Israel. FERC Orders Enron Pipeline to Pay Refunds in California Houston Chronicle | Reuters News Service Thursday, 17 July, 2002 WASHINGTON - U.S. energy regulators said today that a natural gas pipeline owned by bankrupt Enron Corp overcharged firms shipping gas to California during the state's power crisis and must pay refunds. The Federal Energy Regulatory Commission said Enron's Transwestern Pipeline charged unjust rates to San Diego-based Sempra Energy Richardson Products Co. and other companies for natural gas shipments that were primarily used to fuel California's electricity generating plants. California officials had accused the shipping firms of being willing to pay the higher transportation rates so they could then charge higher energy prices in the state. FERC, in its order posted on its Web site, did not specify the total amount of refunds or name all the companies that are due money, saying only that Transwestern must make the payments within 30 days. Other companies believed to have paid higher shipping rates were Astra Power and units of Reliant Energy and BP. "I'm disappointed in the behavior here, very much so," said FERC Chairman Pat Wood. "I'm disappointed in the violations of the tariffs by this (Transwestern) pipeline." The FERC action overturned an October ruling by an agency administrative law judge, who found no evidence of wrongdoing. The refund order comes at a time when FERC is separately investigating Enron's trading unit and dozens of other natural gas and electricity traders to determine if any tried to inflate prices during California's power crisis that began in late 2000 and ended in mid-2001. A ten-fold jump in wholesale electricity prices caused a series of blackouts and the bankruptcy of California's largest utility, Pacific Gas & Electric, owned by PG&E Corp. Agency commissioners scolded Transwestern for charging almost 100 times its regulated transportation tariff of 38 cents per roughly 1,000 cubic feet of natural gas during the winter of 2000-01. For example, Transwestern charged Sempra $231,817 and Richardson Products $143,283 for gas shipments on Feb. 14, 2001. Under its tariff, Transwestern should have charged slightly less than $3,800 for each contract per day, FERC said. "We conclude that Transwestern failed to comply with the tariff posting requirements. Transwestern therefore must return those profits ... plus interest to all of the firm transmission shippers on its system at the time," a FERC order said. FERC also restricted Transwestern's ability to negotiate rate agreements with shippers for one year. The Transwestern Pipeline stretches a total of 2,700 miles from southern California to markets in the Midwest and Northeast. Transwestern is still operating despite the collapse of Enron and recently completed a $72 million pipeline project in Arizona. In a related matter, FERC asked for public comment on whether it should change the agency's policies on allowing natural gas pipeline owners to negotiate rates with shipping customers. Specifically, FERC is reviewing if regulated rates that have specified maximum prices are a viable alternative and safeguard against market manipulation of interstate gas pipelines. The agency will take comments from energy companies, pipelines and consumer groups until mid-August.

Bush Spent Four Times as Much as Gore on Florida Recount, Documents Show Associated Press | Boston Globe - Saturday, 27 July, 2002 WASHINGTON (AP) The Bush campaign spent $13.8 million on lawyers, salaries, travel and hotels to win the Florida recount vote, roughly four more times than the Gore campaign spent, according to Internal Revenue Service documents released Friday. The Gore campaign spent $3.2 million in its losing battle for Florida's 25 electoral votes, mostly from large gifts. Donors included Hollywood producer Stephen Bing and actress Jane Fonda. In contrast, the Bush campaign contributions were almost all $5,000 or less, The Washington Post reported Saturday. Public Citizen, an activist group that advocates enforcing election laws, said Bush's recount fund evaded a campaign-finance disclosure law for a year and a half. The campaign only filed the required forms on the last day of an IRS amnesty program for groups that don't comply, Public Citizen said. Failure to meet the amnesty deadline could have resulted in fines of as much as $6.92 million, Public Citizen said. Benjamin Ginsberg, a lawyer for the Bush recount, said they had no legal obligation to release the document. The only reason they made it public was to avoid controversy. ''We don't think we have a legal obligation to file this,'' he said, adding federal election law doesn't require recount funds to be reported. Gore's recount committee disclosed to the IRS its receipts and expenditures more than a year ago. In addition to paying for lawyers, phones and campaign staff salaries, the Bush campaign $13,000 to Enron Corp. and $2,400 to Halliburton Co. for use of their jets.
