Muslim burial for Malaysian hero

 

Mr Moorthy's widow was in tears after Wednesday's ruling

 

A Malaysian mountaineering hero will be buried as a Muslim, against the wishes of his Hindu wife, who denied he had converted to Islam before his death.

 

The decision follows a High Court ruling that it cannot override the country's Islamic courts in matters of religious conversion.

 

An Islamic court had said the man, M Moorthy, had become a Muslim last year.

 

Lawyers say the case highlights problems faced by non-Muslims dealing with Malaysia's Islamic justice system.

 

"So much for good interracial relations," Haris Mohamad Ibrahim, a lawyer representing Malaysia's Bar Council, told The Associated Press.

 

"The judge has just told the widow and her family to go back and leave the body of their beloved to be buried by strangers."

M Moorthy, 36, was a Hindu when he became a national hero in 1997 as a member of the first Malaysian expedition to conquer Mount Everest.

 

But when he died a week ago family supporters and state Islamic officials jostled one another at the mortuary as each tried to claim his body.

 

An Islamic Sharia court subsequently upheld a claim by his former colleagues in the army that he had become a Muslim last year.

 

However his family, who want him to have a Hindu funeral, were not allowed to appear before the court to dispute his conversion because they are not Muslims.

 

The family went to the civil court and argued that Mr Moorthy was a practising Hindu right up to a recent accident when he fell from his wheelchair and lapsed into a coma.

 

They say he was even interviewed for local television two months ago about his preparations for the Hindu festival of Diwali.

 

But the High Court agreed with government lawyers who argued the civil court had no jurisdiction.

 

Lawyers for the dead man's relatives say the ruling leaves non-Muslims little protection in family disputes considered under Islamic law.

 

Most Malaysians are Muslim but the country's constitution guarantees freedom of worship for all.

Islam is the official religion of Malaysia and non Muslims have no say whatsoever if any rulings are made in accordance with Islam. It is understood that the brother os the deceased is a convert. From what we can undersand is the brother is a culprit in this matter. Without the knowledge of the deceased wife her brother-in-law [deceasewd brother] had help in the conversion. The religious department should be blamed for the secret convertion of Moorthy while bed ridden in hospital.

 

But I think if the civil courts can hear this matter surely evidence will prove that when a person is seriously ill whatever decision he makes without the presence of his wife and children is nullified. But sad to say the civil courst in Malaysia has no juridiction to here Islamic matters. There was a case in the state of Trengganu where 20 Malays had renounced Islam and was arrested by religious body and charged in the syriah court for murtad. These people demanded to be heard in the civil court as the Malaysian constitution guarantees freedom of religioon to its citizen. But the Islamic court says that is not privilaged to Malays as the constitution says all Malays are Mulsim by birth and has no right to convert to any other religion. The article only applies to non Muslims. So, in Malaysia any case pretaining to Islam will not be tried in the civil court but the syriah and if involves non Muslims they are forbbdin to enter an Islamic court.

 

This is what Malaysia calls "JUSTICE" to all. They world is laughing at Malaysia.

Muslims have done this sort of thing many times before. I knew of a Hindu man who married a muslim woman but didn't convert, but when he died they gave him a muslim funeral. His wife who was not religious at the time of their marriage had become more fanatical as she grew older and put pressure on him to convert at which he didn't. As she became more Islamafied she forbid him to do any Hindu puja in the house, saying it's against Islam to allow that.

 

There are many examples of what muslims do when they're in a state of power. They're just showing their bullying attitude, which they see as power.

It seems that the Hindu hero go and converted to Islam without informing his family a few weeks before he died.

 

So now, the family kept insisting that the body should be given a Hindu burial but Department of Islamic Affair (JAIS) insisted he was a Muslim and gave a Muslim burial.

 

A lot of people are upset because of this one idiot's actions of converting.
