This ruling has nothing at all to do with the almond pasteurization standard. It has only to do with certain procedural matters arising from poor legal counsel hired by the plaintiffs. In other words, this is a technical legal (procedural) ruling, not a ruling on the law itself. ______ The ruling by U.S. District Judge Ellen Segal Huvell did not directly address the merits of the almond pasteurization standards. Instead, Huvell dismissed largely on technical grounds the complaint filed by San Joaquin Valley farmers. Huvell determined the farmers had failed to exhaust potential administrative remedies.
