I appreciate hearing from you. SB 250 is a variation of last year's highly controversial AB 1634, a bill that was defeated on the Senate Floor on August 22, 2008 by a wide margin -- with only five Senators voting in favor of the bill and 27 voting in opposition. I voted in opposition to AB 1634. As I have made clear since the introduction of this and similar bills, my continued opposition stems from my experience as a County Supervisor. Animal control policies and ordinances fall under the jurisdiction of local government. Each county or city has the right and authority to establish its own animal control policies and priorities. These may differ from county to county and city to city. I recognize the author's intent of reducing the population of unwanted pets in our communities; however, I remain convinced that such policies should be left to local government discretion rather than dictated by the state. Several local jurisdictions have approved fairly strict local ordinances based upon the animal control needs of those individual communities. I fully respect and support the local representatives' decision to implement them, while also recognizing that similar ordinances may not be desirable or necessary in other areas of the state. SB 250 passed the Senate Local Government Committee on April 15 by a vote of 3-1. I voted in opposition to SB 250 when it came before me in committee. The bill has since been moved to the Senate Appropriations Suspense File. Suspense items will be addressed collectively at one or more separate hearings later in the session.
