I guess if your neighbor doesn't like you, he can report (falsely even) that your dog is vicious and poof! You no longer have your baby. This needs to be killed before all our dogs are! Urgent Alert for Texans Extreme Language in Proposed Bill will Label Dogs that “Seem Aggressive†as “Vicious†Dear Texas Network Members, We need your help to make sure that HB 1982 does NOT become law! In essence  if a dog barks aggressively on its family's property behind a fence and it seems dangerous  it could be deemed vicious. Is Your Dog At Risk?HB 1982 will add the definition of "vicious" dog to Section 822.041A vicious dog would be defined as a dog that:(A) Because of the dog's physical nature and vicious propensity is capable of inflicting serious bodily injury or death to human beings and constitutes a danger to human life or property;(B) Without responsible provocation habitually behaved within the enclosure in which the dog is kept in such a manner that the owner knows or should know that the animal is likely to attack or bite;© Commits unprovoked acts while in the enclosure in which the dog is kept, and those acts cause a person to reasonably believe that the dog will attack and cause bodily injury to that person; or(D) Acts in a highly aggressive manner while in the enclosure in which the dog is kept and appears to a reasonable person to be able to escape from the enclosure. Bill Also Bans Dogs Over 40 Pounds From Dog ParksIn addition, in cities with a population of more than one million, HB 1982 will prevent dogs that weigh over 40 pounds from going to dog parks. The bill states that dogs over 40 pounds will have to be kept on a leash in the immediate control of a person or inside a residence or in a secure enclosure where the dog is kept. Best Friends Animal Society supports well thought out, comprehensive, reckless owner and dangerous dog laws  but this bill is overly broad in its definitions and potentially harmful to innocent animals.
