And they ask for so little in return.Limit Laws on number of dogs is impractical and difficult to enforce especially when the dogs are located within the home. An individual's right to privacy is one of the greatest protections under the Constitution, and the government cannot even enforce this provision with respect to indoor dogs.Two dog owners in Minnesota, have been granted a summary judgement againstthe city for the two (2) dog limit law that the judge called "An invalid exercise of police power violating the Constitutional right to due process.Furthermore, the judge found that the Constitution does protect pet ownership. He declared the law unconstitutional and enjoined the city from enforcement". Do pet limit laws protect the well-being of people and animals?In my view, they do not. Whereas one individual may be able to responsibly care forand nurture several animals, another may be unable to care for even one. And ifproblems arise, enforcement agencies already have ample ammunition at theirdisposal in terms of animal welfare, health and property rights laws. In fact, unsanitary conditions, excessive noise, and interference with property are all unlawful in virtually every community-regardless of whether pets inhabit the premises or not.PET LIMIT LAWS ARE INTRUSIVE AND ARBITRARYJust how are pet limits determined? In one community, the limit might be two pets. In others, three, four, nine, even twenty pets might be allowed. More often than not, the number is arbitrarily chosen.Enforcement is also arbitrary. In response to concerns about pet limit laws, somecommunities have admitted that these ordinances "will be enforced on a complaintbasis (such as in Cary), and pets which are maintained indoors or do not raise the concern of neighbors will not generate enforcement. While it may sound reassuring to some, this justification leaves the window wide open for pet limit laws to be used as a weapon of retaliation and retribution in neighbor disputes over concerns totally unrelated to pets.Laws that regulate a person's behavior inside their home should seek an appropriatebalance between the public's safety and welfare and the individual's right to privacy.But while pet limit laws are highly intrusive, there is little, if any, corresponding benefit to public safety. What good is gained from an uncompromising prohibition against more than alimited number of pets, particularly if they are confined to an owner's property and create no problems? Certainly, if neighbors are totally unaware of their presence, prohibiting pets does not in any way protect or maintain anyone's health, happiness or peace of mind. And what about multi-pet households where neighbors do not mind or even enjoy the presence of these animals? In fact, there is no benefit gained from such a prohibition-nor is there likely to be any enforcement.Ask yourself the following question: Should our government pass laws that are not going to be enforced?I AKS THAT THE REPEAL OF THIS USELESS TWO (2) PET LIMIT LAW.Sincerely,********************************************************************************BACKGROUND:There is a two dog limit law which is hampering my efforts as a volunteer for a local animal rescue group. I hope you can help. There are many animals that are slipping through foster homes and rescue facilitis due to this LIMIT.The limit law was first implemented in 1964. My research has turned up no valid reasoning behind it. My understanding would be that when one enforces a limit law it is usually a personal matter not a limit matter.There are 14 other animal laws that the city could enforce, but does not because the 2 dog ruling is quick and dirty. On Thursday night I went in front of our local Town Council. They may have slammed the door in my face. They did not receive me well at all. After many hours of research I could not find (in public records) any reason for this law to have been put in place. The only thing I could come up with was a health and safety issue, but knowing Cary it was more of a control issue. I believe this could potentially be "Selective Enforcement" . There have bee
