BCN41:APPEALS COURT STRIKES DOWN PROTEST RESTRICTIONS AT COW PALACE

SAN FRANCISCO (BCN)

An animal rights activist won the right from a federal appeals

court today to pass out leaflets and demonstrate at rodeos and circuses

at the Cow Palace just south of San Francisco.

The 9th U.S. Circuit Court of Appeals in San Francisco said the

facility's policy of restricting protests to three zones on the

perimeter of a parking lot violated the right of free speech in the

California constitution.

The ruling was made in a federal lawsuit filed three years ago by

Alfred Kuba of Mountain View, who is the coordinator of Silicon Valley

In Defense of Animals.

Kuba said this morning, " This is a tremendous victory for us and

for everyone in the state of California who wants to exercise their

constitutional rights. "

The Cow Palace was built just south of the southern boundary of San

Francisco in 1941 for livestock exhibitions. It is now used for the

annual Grand National Rodeo and Stock Show and other events including

circuses.

The facility is owned by the state and is run by a state agency

called the 1-A District Agricultural Association.

The association argued that the rules restricting protests were

needed to prevent traffic congestion and protect pedestrians and

drivers.

But the appeals court ruled that the association's policy was far

more restrictive than needed to achieve that aim.

Circuit Judge Marsha Berzon wrote that the agency's rule " prevents

far more speech than is necessary to achieve the goals of preventing

congestion and ensuring pedestrian and driver safety. "
