Hi! I manage a rawfoods listserve called SD-LivingFoods serving the

Southern California area. The following info was submitted to the

list. I personally know and have been close friends with the couple

whom this e-mail is about. This ordeal has been going on for them for

several years and I had thought it was resolved. Evidently that is

almost 6 months, on false charges! She is 5'5 and is 94 pounds now.

Down from 112 when she initially was incarcerated. They won't allow

anyone to feed her properly. She is deteiorating quickly. They are

now going public with her plight. Help if you wish. They used to

live in SD and have been longtime Earthsave members/leaders. Details

Enjoyed chatting over the phone.

 

Here is the letter I just sent up the the Sacramento Vegetarian

Society:

 

Patty Berry, one of your members, who is completing the new

Vegetarian Restaurant in Pollock Pines, forwarded your e-mail address

to us.

 

She thought the membership might want to know how a corrupt court in

Placerville, CA has managed to even the score with a vegetarian

woman, who dared to be a whistle blower on its corruption back in

1999, which whistle blowing helped cause one of their corrupt judges

(The Family Law Commissioner) to be fired.

 

That Placerville court reached all the way to New Mexico, via the

FBI, and, on completely phony charges (they'd done the exact thing

back in 1998 in CA), had KT DeLettre Lambart arrested in a violent

gun-to-the-forehead handcuffing, after being thrown to the floor of

her home, in front of her little 8 year old boy, and her husband was

similarly treated the same violent way, also being handcuffed in

front of young Buddy.

 

The FBI kidnapped (took by force against his will) little Buddy, and

flew him to CA and, against CA law, put him back in the hands of his

court proven perpetrator of abuse and domestic violence against both

the child and mother. KT was forcibly taken away by the FBI and

incarcerated with NO BAIL possible ($500,000! Bail with NO bond - a

figure so high that it is not usually seen, accept in serial killer

arrests), a good two hour drive from her home in New Mexico. The next

morning, learning of discrepancies in the arrest warrant from CA, the

FBI dropped all their charges, but KT remained jailed in Las Cruces,

now held on the CA warrant from Placerville, even though the FBI

completely washed their hands of involvement - even apologizing to

me, her husband.

 

But the damage was done, and the nightmare only begun.

 

The excessive bail amount directly violated the supreme law of the

United States, the Constitution. The 8th article of the Bill of

Rights prohibits " excessive bail " being set on anyone.

 

That was just the first obvious violation of her Rights.

 

KT is, along with her husband Ric - who's been all raw vegan for 26

years - a strict raw fooder, which dietary is a fundamental part of

their spiritual and religious convictions.

 

Ric spoke to the Prison Chaplain and showed him enough of their

religious doctrine to convince the Chaplain that this was a genuine

religious dietary mandate. So, for the first time, and based on the

Constitutional Right providing all of us with absolute religious

freedom to follow our beliefs, the Jail arranged to have its food

contractor go to the local natural food co-op in Las Cruces twice

each week to order organic foods for KT in the Jail.

 

But, sadistic guards did not like this " special diet " and managed to

regularly sabotage it by giving KT the proper foods, but in inedible

form. They gave her organic bananas, but they were rock hard green,

so she couldn't eat them, and they did the same thing with other

fruits, including avocados. Since KT was not allowed to keep the

food in her cell, until it was ripe, she had to go without. On top

of this, they further tortured her for having this diet by keeping

some of the fruits and vegetables in the open kitchen until they were

rotten, spoiled, and/or moldy - then they'd send them in to her

cell. Of course she couldn't eat these inedibles, so she slowly

began to starve from lack of balanced and adequate caloric intake.

 

She was incarcerated on June 13, 2002, almost six months ago. One

week ago her weight was down to only 94 (fully clothed) pounds, and

she'd never carried any extra weight, being of slim build. She was

usually over 112 pounds, and was in perfect and vibrant health the

day they arrested and incarcerated her. Today she is skin and bones

and has all sorts of physical troubles, from Kidney pain, swelling in

her extremities, to severe back pain, and she can barely walk, having

to move very slowly. She has little energy and cannot sleep in her

cell. Constant stress, sadistic treatment, and inadequate caloric

intake have taken a terrible toll.

 

In Las Cruces they put her in solitary confinement for 45 days, but

she complained to the administration of the unfounded and unjustified

abuse, and pointed out that the prison had violated her

Constitutional rights by such cruel and unusual punishment (violates

her same 8th Amendment Right, which prohibits " cruel and unusual "

punishment), so they released her from " lockdown " after some two

weeks of that painful form of additional abuse and torture. During

that period they wouldn't even let her husband see her, and all

visits were restricted to seeing her through bullet proof glass,

where their conversation between the separate rooms was monitored on

a phone the prison claimed they tapped.

 

The prison denied her other constitutional rights with abandon: for

instance, they refused to allow her to act as her own counsel,

instead first imposing a public defender on her, a man who never

spoke to her even once for the almost month he was placed over her to

keep her incommunicado. This trick by the prison enabled the

Placerville District Attorney to push Governor Gray Davis, who knew

only what the DA told him, for the quick issuance of an extradition

warrant, to force New Mexico to return KT to CA and her Placerville

persecutors. Not knowing the case's background (the record of her

being a victim of domestic abuse, of having been awarded full custody

of her son, of having been told by the court that she could live

anywhere in the continental U.S., and that she had a right to

a " confidential " address [a CA law designed to protect victims of

domestic violence from stalking former mates and those who have

threatened to kill them - for the family's protection]), the Governor

approved the issuance of that extradition order, demanding that New

Mexico turn KT over to their Sheriffs. The Placerville DA, by

concealing the court records of her victim status, committed fraud.

They were duty bound to present the Governor with all the facts.

 

KT has been in Jail for all this time, without having been convicted

of anything. She was always law abiding, never even getting traffic

tickets. She fought extradition to CA, which we all felt might be the

end of her, since the vendetta against her for being a whistle blower

in 1999 had lead to the firing of the judge (Commissioner) over her

case. The old sense of retaliation had taken over: Placerville's DA

and Court had reason to be very interested in her demise.

 

KT has not heard anything about the condition of her son, Buddy, for

all this time. She hasn't been allowed any contact or information.

While in New Mexico, and before, she religiously saw to it that her

son called his biological father at least once every single week -

never missing one call.

 

You might wonder how could all this happen in America? Well it can,

and KT's case in not even unique. The CA law prohibits perpetrators

of domestic violence from having unsupervised contact with their

children. As in KT's case, her ex husband was ordered to enter a 52

week batterer's and anger management program, which he never

completed. At the end of her two years of litigation over her

custody issue and the first fraudulently leveled " parental

kidnapping " charges against her, KT and her new husband were broke.

They no longer had enough money left to even travel to Placerville

from their home in San Diego - a 10 to 12 hour (one way) drive from

their home - a trip they made at least once every week during the

years of litigation. They were so financially ruined from all the

costs involved in Placerville, that they had to move to a lower cost

of living area, which is why they moved to New Mexico.

 

In her absence, while in New Mexico, unbeknownst to her, the court,

without making sure she was properly and fairly notified, held a

change of custody hearing in the middle of 2000, awarding, because

the hearing was UNCONTESTED (by virtue of KT's absence from the

courtroom), custody to the abusive father. This broke a CA law

prohibiting such an award, proving that KT's whistle blowing reform

efforts of the Placerville court had been to no avail. The

Placerville Court was back to their old habit of ignoring the very

laws they had sworn they would uphold, when each judge takes office.

 

This is what led to KT's arrest and frightening ordeal, and the

ruination of her once superb health. Her life is now in extreme and

precarious, in imminent danger. She is rapidly failing.

 

Her religious beliefs also prohibit treatment by Allopathic

pysicians, who do not understand her dietary and health beliefs. She

lives in fear they will force medications and other medical procedure

on her against her will and beliefs, which could also lead to her

death.

 

The situation is most grave. KT must be freed - and without further

delay.

 

There is absolutely no reason to further punish her in such a cruel

and unusual fashion. Again, SHE HAS NOT BEEN CONVICTED OF ANY CRIME

WHATSOEVER.

 

KT is rotting in jail, her life slipping away, for only one reason -

she is being victimized by the " Hangtown USA " (how the town bills

itself to tourists) authorities, who have done no more than accuse

her of something that they already did back in 1998, which she then

proved was untrue. Their singular reason is that they are teaching a

lesson to anyone else who might have the courage to become a whistle

blower.

 

KT's whistle blowing in 1999 not only helped get her judge fired, but

it also cause the legislature to pass a new bill to further protect

victims from the kind of violence to which KT had been subjected.

 

State Senator Sheila Kuehl has written a letter directly to the

Governor urgently requesting him to have KT released, so that she can

defend herself against these maliciously abusive charges. But the

governor has not shown the courage to admit he made a grievous error

is issuing his extradition warrant.

If there is anything you can do, from circulation of an Internet

petition (which you soon find on the first web site above) to " FREE

KT, " to urging your representatives to investigate the cruel and

unusual punishment - and malicious treatment KT is receiving while

imprisoned - it will be deeply appreciated.

 

The Jailers in Placerville are NOT honoring KT's religious rights to

eat according to her beliefs, and they have not only refused to bring

her clean bottled water, but have turned away a special delivery of

the proper foods, arranged and paid for by Patty Berry, your fellow

member, of Sacramento and Pollock Pines, CA.

 

KT has not seen the outside world for all these months, accept for

the few hours, when the Placerville Sheriffs transported KT from New

Mexico last Friday, via airlines. She was handcuffed the whole trip.

Any time she went to court while in New Mexico, as also in

Placerville, her ankles are chained painfully together, and she is

dressed in a bright humiliating red or orange prison jump suit and

chains also shackle her handcuffed wrists to a chain about her waist

- as though she were a violent and crazed murderer.

 

Is this really America? What has happened to us that we can tolerate

this sort of inhumane abuse by the very authorities instituted to

protect us from abuse, violence, and to assure that our cherished and

sacred Constitutional Rights are fully honored?

 

Again, you can help. You can call your legislators, you can speak

out, you can write or call (530.621.6600, or 530.621.5655) the

Sheriff of El Dorado County, Hal Barker, and ask him to please at

least respect KT's Constitutional Rights to obey her religious

dictates, and get the food she is supposed to eat. You can tell him

that a public spirited woman, Patty Berry, went to the trouble of

even spending her own money for such food, properly packaged it for

KT, but that this food was refused by his prison administration. It

was never delivered to KT, whose weight is dangerously low from slow

starvation.

 

You can ask Sheriff Barker why, if New Mexico authorities at least

honored this Constitutional right to religious freedom, his people

aren't willing to do likewise, since you assume he is a proud

American, who also respects the Constitution.

 

After all, our Constitution is officially the SUPREME LAW OF THE

UNITED STATES. No other law, code or administration rule can EVER

be allowed to conflict with the Constitution's dictates.

 

If you alert Sheriff Barker, and appeal to his common decency,

compassion and Americanism, he just might intervene - and correct

this terrible situation, before it is too late and KT is rendered

just one more victim in the statistical data banks.

 

If you do call, which we hope you will have the courage to do, please

make sure and do not be accusatory or belligerent in your demeanor or

tone, since they hold KT as their hostage. Such irate calls from

citizens in New Mexico only caused the prison personnel to take it

out on KT, who they hold under their total physical control. Sheriff

Barker is in that same position of total control of KT. The jail

comes under his command. Her life and death are literally in his

hands.

 

We only wish him to at least respect her sacred right to freedom of

worship and belief, to have the food she requires, and to have the

pure and un-chemicalized water she needs to maintain her hydration.

 

The legal issues and matters, we can deal with, and KT is very

talented in that area, but if de-energized and in pain, she will not

be able to do the legal things required to regain her freedom.

 

Please respectfully tell Sheriff Barker that you are concerned, you

are vegetarians and are troubled by this discriminatory restriction

of her religious rights to have the food her religious beliefs

dictate she must have. It is discriminatory and a violation of her

rights - to continue to deprive her of the nutrients needed for her

to regain her rapidly deteriorating health.

 

Please help any way that you can. If you believe in the power of

prayer, please pray for KT - and also for her young son, Buddy's,

protection, as well.

 

Feel free to forward this message to anyone you know who might like

to speak out.
