I've been tx a patient for a while whom we have reason to suspect candida

based on sx presentation/med hist. she is highly reluctant to present at

great smokies/lenova (we live in asheville) because she doesn't want to get

involved in the west med world work-up. any ideas about how to get a stool

test for candida without going through an MD?

Kath,

Great smokies, which is now called Genova labs works with all licensed

practitioners, not just MDs.  I have ordered tests from them on multiple

occasions.

I am pretty sure that (now) Genova requires a L.Ac to be under someone else

to order tests (e.g. M.D. , ND etc.) However, there is also Metametrix.

Just ordered and received tests from Genova this week. It may be because CA

Lac's have this as part of their scope of practice - call'em, find out and

let us know!

i'm looking for some specific tests on stool samples for parasites that from

what i understand only a few labs do, including genova and diagnostecs, not

a general blood/lipid panel. i'm also interested in a finger prick blood

test for food allergies from biotech.

Kath,

Many state regulatory boards are not supposed to provide legal advice and that

usually includes interpretation of statutes. Seems odd when you call and want to

know beforehand if you are following the law. They seem to want to force you to

act and then there can be a legal reaction filed, hearing, etc. Our statutes in

many states do not allow for LAc to order lab tests, a few are different on this

issue. Maybe you can find another provider such as a ND or DC in your state

that will work with your patient. Best of luck in your search.

Genova does lab tests for California acupuncturists with no requirement for an

MD referral. When I lived in Asheville for 5 years, Great Smokies (now Genova)

would do lab tests for me. Stool tests for candida should be no problem. Blood

tests may be a problem.

Kath -

Mike is right. This is a state by state issue that is dependent upon the legal

code. When I practiced in California, I ordered Great Smokies work ups. Itwas

much more difficult in Massachusetts where the code did not provide for such

work. Then, the more common is the grey zone states with a lack of clarity in

the scope of practice language.

Mike - I have to disagree about state regulatory boards and interpretation of

statutes. State boards - across the board - are required to write rules. The

rules language is an interpretation of code for the purpose of regulating a

profession.

I think that the interpretation you are referring to is the application 'in a

single case' as opposed to the rulings affecting the professional practice.

Warmly,

fyi: went to genova website and filled out a form for a starter kit. got

this back from them:

To properly offer our services to you, we are required to comply with

Centers for Medicare and Medicaid Services guidelines that determine who may

order lab tests. The Clinical Laboratory Improvement Amendments of 1988,

(CLIA) established regulations governing laboratory testing in order to

protect both patient and practitioner. These regulations state that a

clinical laboratory may perform laboratory services and report results only

upon the order of a physician or other person authorized by the state law to

order those tests.

If you are one of the following degrees; *(MD, DPM, DO, DC, Optometrist,

DDS, LNP, LPA- you do need a physician authorization.) Any other degree

type, please complete the Client information form and have an Authorizing

Physician complete the form, along with the Physician Authorization forms.

Once complete, please fax the paperwork to the number below, with a copy of

license.*

Please fill out the enclosed Client Information Form and fax back to

828-252-9303 along with a copy of your state license and we will set up an

account for you. Once the account is activated you will be able to order

testing from Genova Diagnostics. In 3 – 5 days you will receive a Getting

Started packet detailing all that we offer as a laboratory including

pricing.

followed up with a phone call. in nc, only the degrees listed in bold can

order tests from them. others have to get a practitioner with one of those

degrees to co-sign/authorize you. patients cannot go direct, must go

through one of these physicians. they do not have docs at the facility for

practitioners or patients to go through.

Yes, I always ordered tests from Genova in the past, but recently they told

me that they would not do that any more. I guess they just don't want to get

into trouble with a gray area.

Re: How to get Candida Stool test without going through MD?

fyi: went to genova website and filled out a form for a starter kit. got

this back from them:

In 3 - 5 days you will receive a Getting

Will,

I am not sure that I see any distinction with single cases vs professional

practice. They really appear to be the same. As individuals, these regulations

are directed at us, as part of the profession. Maybe you could explain how you

separate these two.

The

rules language is an interpretation of code for the purpose of regulating a

profession.

I think that the interpretation you are referring to is the application 'in a

single case' as opposed to the rulings affecting the professional practice.

act and then there can be a legal reaction filed, hearing, etc. Our statutes in

many states do not allow for LAc to order lab tests, a few are different on this

issue. Maybe you can find another provider such as a ND or DC in your state

that will work with your patient. Best of luck in your search.

Hi Mike, I should have been more clear. I was referring to judgments rendered by

a board. They will make collective rulings and sometimes be disinclined to

advise in a single case.

Kath,

I have never had problems ordering labs from Genova, either from California or

North Carolina. I just received a new shipment of test kits from them yesterday.

It may be that when I moved to North Carolina in 1998, they were still working

off my original account from California. Now that I'm back in California since

2003, the account number is still the same. That could explain whey they are

treating us differently.

Will,

Thanks for clarifying. It will be a great day when our profession is equal

across all states. It will be awhile, I think, due to schools, organizations

and practitioners, all with differing opinions of who and what we are and how we

are to practice. Thanks for all the hard work you have done on our behalf.
