Seems odd when you call and want to know beforehand if you are following the law. They seem to want to force you to act and then there can be a legal reaction filed, hearing, etc. Our statutes in many states do not allow for LAc to order lab tests, a few are different on this issue. Maybe you can find another provider such as a ND or DC in your state that will work with your patient. Best of luck in your search. Michael W. When I lived in Asheville for 5 years, Great Smokies (now Genova) would do lab tests for me. Stool tests for candida should be no problem. When I practiced in California, I ordered Great Smokies work ups. Itwas much more difficult in Massachusetts where the code did not provide for such work. Then, the more common is the grey zone states with a lack of clarity in the scope of practice language. Mike - I have to disagree about state regulatory boards and interpretation of statutes. State boards - across the board - are required to write rules. The rules language is an interpretation of code for the purpose of regulating a profession. I think that the interpretation you are referring to is the application 'in a single case' as opposed to the rulings affecting the professional practice. The Clinical Laboratory Improvement Amendments of 1988, (CLIA) established regulations governing laboratory testing in order to protect both patient and practitioner. These regulations state that a clinical laboratory may perform laboratory services and report results only upon the order of a physician or other person authorized by the state law to order those tests. If you are one of the following degrees; *(MD, DPM, DO, DC, Optometrist, DDS, LNP, LPA- you do need a physician authorization.) Any other degree type, please complete the Client information form and have an Authorizing Physician complete the form, along with the Physician Authorization forms. Once complete, please fax the paperwork to the number below, with a copy of license.* Please fill out the enclosed Client Information Form and fax back to 828-252-9303 along with a copy of your state license and we will set up an account for you. Once the account is activated you will be able to order testing from Genova Diagnostics. I guess they just don't want to get into trouble with a gray area. They really appear to be the same. As individuals, these regulations are directed at us, as part of the profession. Maybe you could explain how you separate these two. Michael W. This is a state by state issue that is dependent upon the legal code. When I practiced in California, I ordered Great Smokies work ups. Itwas much more difficult in Massachusetts where the code did not provide for such work. Then, the more common is the grey zone states with a lack of clarity in the scope of practice language. Mike - I have to disagree about state regulatory boards and interpretation of statutes. State boards - across the board - are required to write rules. The rules language is an interpretation of code for the purpose of regulating a profession. I think that the interpretation you are referring to is the application 'in a single case' as opposed to the rulings affecting the professional practice. They will make collective rulings and sometimes be disinclined to advise in a single case. I just received a new shipment of test kits from them yesterday. It may be that when I moved to North Carolina in 1998, they were still working off my original account from California. Now that I'm back in California since 2003, the account number is still the same. It will be awhile, I think, due to schools, organizations and practitioners, all with differing opinions of who and what we are and how we are to practice.
