How many of you have put your product(s) thru challenge testing--and have product liability insurance? At what point in your sales volume did you feel it was 'time'--at the beginning?....once you hit a certain '$$$ in earnings? I got hit this weekend with a barrage of 'what if's that really have given me some cause to think about if I want to continue soaping at all. I do have 1 product which is doing great things for everyone whos using it. One of my customers is really pushing me to market it to the local cancer treatment center, for what it could do for the patients suffering from radiation burns. She bought it to use on her radiation treatment burns, which were several months old, still painfull, and scaring. She says using my product has taken all the scars away--and so is the pain. If this really could be of help--I'd be a pretty shitty person to pull the plug on it----but, on the other hand....what if someone used it--and then dies---and the family says in part, it's due to my product--or, that it's otherwise harmed them---gawd, it's such a mess. This morning I was even entertaining the thought of putting this one product thru testing, then see if there's a company who's willing to buy & market it so it is available for helping those who could really benifit from it--without me being the one to suffer if someone got a twig up the patoot....well, you know what I mean. This has really opened a can of worms up for me. Guest guest Posted November 22, 2005 Report Share Posted November 22, 2005 Goody, In this the age of " law suit abuse " If you put a common sense precaution, and make sure that it's stated that it's not a medicinal product and use all the legal jargon that one can to protect themselves from that one person. (Ie you don't make claims that you can treat or cure anything unless it has been tested and the FDA has approved it for that specific purpose.) Then you should be safe... If you want to market to cancer centers as a pharmaceutical type cream then you would have to get the testing done. If your product is that good then it is worth it. I would definitely take the time to do all the testing etc If I was going to market to The public enmasse for a specific purpose. Until you have it tested etc. You cannot make any claims and that is where cosmetics (IE body lotions) and " medications " (claim they can cure dry skin or psoriasis or eczema) differ.
