For your company name you will have to register with your state and/or local government for your business license, which will be in your company name. Your chosen name must be available with the government you register with. Someone in the state over may be using the same name...that's perfectly legal. (I'm not sure how the big National corporation names are handled - I assume there is some sort of way to " buy " your name nationwide, but the $$ involved?). For example, I work for American Book Company, Inc., a book wholesaler. We are incorporated in Florida. In order to do business in other states, we must provide them with a certified copy of our articles of incorporation, proving that we are a legal corporation...otherwise they could require us to incorporate in *their* state. There is another " American Book Company " in existence, that publishes textbooks. No relation. I don't know where they are incorporated...but it's not Florida, since we " own " the name there! On the domain name, as someone else has already stated, there are domain name " speculators " that buy up likely domains then try to resell them...at a substantial mark-up. Sounds like in your case, this other vendor saw & liked your signature name, and jumped on it. Since she's not actually using it, I would consider checking to see if she would be willing to relinquish it to you (for a reasonable price). If not, I think I'd try to come up with an alternative for your website rather than waste time & money pursuing her...while punishing her for a petty " theft " would be satisfactory I'm not sure it would be worth the time and money to try. My company's website is www.americanbookco.com, as www.americanbookcompany.com was not available (already owned by the Publisher I mentioned). Perhaps you could see if www.bontanicalaroma.com is available, or another similar domain name?
