This a condition of employment. It is not descriminating against the person but against the drug if the person is fired for use of a drug even if it medically prescribed. If it were acceptible to employ a person using medical marijuana then they would have to allow all employees to use the drug. I'm not a big Walmart fan, but I have to side with them on this. They cut peoples hours who are full time and use part time people on those hours mainly to pay a lower wage which is a fact. They are the largest importer from china which has cost americans their jobs by their companies going to other countries to pay lower wages without benefits. Last November, Walmart fired him after 5 years on the job because he tested positive for (legal) marijuana. Joseph Casias, 29, has sinus cancer and an inoperable brain tumor. Despite his condition, he has dutifully gone to work every day for the last five years at a Walmart in Battle Creek, Michigan, where in 2008 he was named Associate of the Year. Casias is also a legal medical marijuana patient under Michigan state law. He uses marijuana with the recommendation of his doctor to relieve the effects of cancer. But Walmart, the world’s largest public corporation, has no sympathy for his condition or regard for Michigan’s state law. Last November,Walmart fired Casias because he tested positive for marijuana during a routine drug screening. Here’s what a Walmart spokesman had to say: “In states, such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen. We believe our policy complies with the law and we support decisions based on the policy.â€� To add insult to injury, Walmart is now challenging Casias’ eligibility for unemployment. Simply outrageous. This is the thanks he gets for showing up to work and doing his job for the last five years, despite being stricken with a life-threatening illness. “I gave them everything,â€� Casias told a local news outlet. “One-hundred- ten percent every day. Anything they asked me to do I did. More than they asked me to do. Twelve to 14 hours a day.â€� Sadly, the dilemma facing medical marijuana patients who still have no legal protection from being fired is nothing new. Please don't play the pot card here. This whole string of messages is not about pot but about what an employer's rights are in maintaining its workforce and its rules of employment. For instance, if an employer insists that you must wear a necktie it becomes a condition of employment, If an employee develops a goiter that presents a problem with wearing a tie, that employee may be terminated - at least until the goiter is removed. Walmart brings it on all by themselves. They cut peoples hours who are full time and use part time people on those hours mainly to pay a lower wage which is a fact. They are the largest importer from china which has cost americans their jobs by their companies going to other countries to pay lower wages without benefits. This a condition of employment. It is not descriminating against the person but against the drug if the person is fired for use of a drug even if it medically prescribed. If it were acceptible to employ a person using medical marijuana then they would have to allow all employees to use the drug. I'm not a big Walmart fan, but I have to side with them on this. Should a person with a goider not be able to wair a tye, the employer has the oblagation under the ADA to acomadate his disability! they can and do loose action taken against them for discrimanation of this kind. Just as an employer would loose action taken if they refused to acomadate a blind person such as myself. If I work at a job or get highered to do a job that requires in there rules that a person be able to see 25 feet in frunt of them and they fire me damote me etc because I can not see 25 feet in frunt of me they will loose that batter and will be forced to acomadate. its called resinable acomadation. I am very well edgacated on this matter, and actually one a law sute against a company denying me employment or training because of just the sanario I described. The ADA is very powerful and employers do not have the rite to descrimanate based on gender disbility etc. I would nto be shocked if this many sues and walmart pays out the nose or fireing him based on a disability or med he takes for his disability.
