MADRID: Today the Spanish Senate, acting to confirm a decision already taken under pressure from powerful governments accused of grave crimes, will limit Spain’s laws of universal jurisdiction. Yesterday, ahead of the change of law, a legal case was filed at the Audiencia Nacional against four United States presidents and four United Kingdom prime ministers for commissioning, condoning and/or perpetuating multiple war crimes, crimes against humanity, and genocide in Iraq.

 

This case, naming George H W Bush, William J Clinton, George W Bush, Barack H Obama, Margaret Thatcher, John Major, Anthony Blair and Gordon Brown, is brought by Iraqis and others who stand in solidarity with the Iraqi people and in defence of their rights and international law.

 

Iraq: 19 years of intended destruction

 

The intended destruction — or genocide — of Iraq as a state and nation has been ongoing for 19 years, combining the imposition of the most draconian sanctions regime ever designed and that led to 1.5 million Iraqi deaths, including 500,000 children, with a war of aggression that led to the violent deaths of over one million more.

 

Destroying Iraq included the purposeful targeting of its water and sanitation system, attacking the health of the civilian population. Since 1990, thousands of tons of depleted uranium have been dropped on Iraq, leading in some places to a 600 per cent rise in cancer and leukaemia cases, especially among children. In both the first Gulf War and “Shock and Awe†in 2003, an air campaign that openly threatened “total destructionâ€, waves of disproportionate bombing made no distinction between military and civilian targets, with schools, hospitals, mosques, churches, shelters, residential areas, and historical sites all destroyed.

 

Destroying Iraq included promoting, funding and organizing sectarian and ethnic groups bent on dividing Iraq into three or more sectarian or ethnic entities, backed by armed militias that would terrorize the Iraqi people. Since 2003, some 4.7 million Iraqis — one fifth of the population — have been forcibly displaced. Under occupation, kidnappings, killings, extortion and mutilation became endemic, targeting men, women and even children and the elderly.

 

Destroying Iraq included purposefully dismantling the state by refusing to stop or stem or by instigating mass looting, and by engaging in ideological persecution, entailing “manhuntingâ€, extrajudicial assassinations, mass imprisonment and torture, of Baathists, the entire educated class of the state apparatus, religious and linguistic minorities and Arab Sunnis, resulting in the total collapse of all public services and other economic functions and promoting civil strife and systematic corruption.

 

In parallel, Iraq’s rich heritage and unique cultural and archaeological patrimony has been wantonly destroyed.

 

In order to render Iraq dependent on US and UK strategic designs, successive US and UK governments have attempted to partition Iraq and to establish by military force a pro-occupation Iraqi government and political system. They have promoted and engaged in the massive plunder of Iraqi natural resources, attempting to privatize this property and wealth of the Iraqi nation.

 

Humanity at stake

 

This is but the barest summary of the horrors Iraq has endured, based on lies that nobody but cowed governments and complicit media believed. In 2003, millions worldwide were mobilized in opposition to US/UK plans. In going ahead, the US and UK launched an illegal war of aggression. Accountability has not been established.

 

The persons named in this case have each played a key role in Iraq’s intended destruction. They instigated, supported, condoned, rationalized, executed and/or perpetuated or excused this destruction based on lies and narrow strategic and economic interests, and against the will of their own people. Allowing those responsible to escape accountability means such actions could be repeated elsewhere.

 

It is imperative now to establish accountability for US and UK war crimes, crimes against humanity and genocide in Iraq because:

 

Every Iraqi victim deserves justice.

 

Everyone responsible should be accountable.

 

We are before immoral and unlawful acts, contrary to the basis on which the international order of state sovereignty and peace and security rests. Whereas the official international justice system is closed before the suffering of those that imperialism makes a target, through this case we try to open a channel whereby the conscience of humanity can express its solidarity with justice for victims of imperial crimes.

POR LA JUSTICIA PARA IRAK

 

QUERELLA CRIMINAL PRESENTADA CONTRA CUATRO PRESIDENTES DE ESTADOS UNIDOS Y CUATRO PRIMEROS MINISTROS DEL REINO UNIDO POR CRÃMENES DE GUERRA, CRÃMENES DE LESA HUMANIDAD Y GENOCIDIO EN IRAK

 

MADRID: Ayer el Senado español, confirmando una decisión tomada bajo la presión de poderosos gobiernos acusados de graves delitos, aprobó una ley limitando el ejercicio de la jurisdicción universal en España.

 

El seis de octubre, un día antes de la votación en el Senado, una querella criminal fue presentada ante la Audiencia Nacional de Madrid contra cuatro presidentes de los Estados Unidos y cuatro primeros ministros del Reino Unido por la comisión, justificación y/o la perpetuación de múltiples crímenes de guerra, crímenes de lesa humanidad y genocidio en Irak.

 

Esta querella, que señala a George H. W. Bush, William J. Clinton, George W. Bush, Barack H. Obama, Margaret Thatcher, John Major, Anthony Blair y Gordon Brown, fue presentada por iraquíes y otros que actúan en solidaridad con el pueblo iraquí y en defensa de sus derechos y del derecho internacional.

 

Irak: 19 años de destrucción intencionada.

La destrucción intencionada - o genocidio - de Irak como Estado y nación, ha transcurrido a lo largo de los últimos 19 años, y sigue cometiéndose hasta el momento. Este genocidio ha combinado la imposición de las sanciones más crueles jamás impuestas contra un régimen, y que condujeron a la muerte de 1,5 millones de iraquíes incluyendo 500.000 niños, con una guerra de agresión que hasta la fecha ha conducido a la muerte violenta de más de un millón de personas.

 

La destrucción de Irak ha incluido el ataque intencionado a plantas de tratamiento de agua y el sistema de saneamiento, agrediendo asimismo a la salud de la población civil. Desde 1990, se han lanzado en Irak miles de toneladas de uranio empobrecido, causando en algunos lugares un aumento de hasta un 600 por ciento de casos de cáncer y leucemia, especialmente entre los niños. Tanto en la primera Guerra del Golfo como en la Operación ‘Conmoción y Pavor’ de 2003, campañas de bombardeo aéreo amenazaron abiertamente con una ‘destrucción total’. Estas desproporcionadas olas de bombardeos no distinguieron entre blancos militares y civiles. También causaron la destrucción de escuelas, hospitales, mezquitas, iglesias, refugios, zonas residenciales y sitios históricos.

 

La destrucción de Irak ha incluido la promoción, financiación y organización de grupos étnicos y sectarios interesados en la partición de Irak en tres o más entidades. Estos grupos son respaldados por milicias armadas cuyo propósito es aterrar al pueblo iraquí. Desde 2003, cerca de 4,7 millones de iraquíes (una quinta parte de la población) han sido desplazados a la fuerza. Bajo ocupación, los secuestros, asesinatos, extorsión y mutilación se han vuelto endémicas. Tanto mujeres como hombres, niños y ancianos han sufrido las consecuencias.

 

La destrucción de Irak ha incluido el desmantelamiento intencional del Estado. Se ha denegado, evitado e incluso alentando un patrón de saqueos masivos, mientras se han realizado persecuciones ideológicas, asesinatos extrajudiciales, encarcelamientos completamente arbitrarios y tortura de miembros del Partido Baas y de toda la clase media, a las minorías religiosas y lingüísticas, y a los árabes sunitas, resultando en el colapso total de todos los servicios públicos y la economía, promoviendo conflictos civiles y corrupción sistematizada.

 

Mientras, y de manera profundamente cruel, el rico patrimonio cultural y arqueológico de Irak ha sido destruido.

 

Para tratar de convertir a Irak en un Estado dependiente de los Estados Unidos y del Reino Unido, sucesivos gobiernos de estos países han intentado imponer la partición del país y establecer mediante el poder militar un gobierno iraquí a favor de la ocupación. Han alentado y participado en el saqueo generalizado de los recursos naturales con la intención de privatizar lo que es propiedad y riqueza de la nación iraquí.

 

La Humanidad está en juego.

Este es apenas un breve resumen de los horrores que Irak ha tenido que soportar, una realidad que no pudo haberse impuesto sin las mentiras que solo los gobiernos intimidados y la prensa cómplice creyeron. En 2003, millones de personas alrededor del mundo se movilizaron en contra del plan de Estados Unidos y Reino Unido. Y a pesar de la oposición popular, los Estados Unidos y el Reino Unido lanzaron una ilegal e ilegítima guerra de agresión.

 

Hasta el día de hoy, estos terroríficos crímenes permanecen impunes.

 

Cada uno de los querellados en esta causa ha desempeñado un papel clave en la destrucción deliberada de Irak. Estas personas han instigado, apoyado, consentido, racionalizado, ejecutado y perpetuado o justificado esta destrucción, basándose en mentiras y limitados intereses estratégicos y económicos, y en contra de la voluntad de millones de ciudadanos de todo el mundo. Permitir que los culpables evadan su responsabilidad significaría un precedente que la Humanidad no se puede permitir.

 

Es imprescindible establecer la responsabilidad de los querellados por los crímenes de genocidio, de lesa humanidad y de guerra cometidos en Irak por Estados Unidos y por el Reino Unido puesto que:

 

Cada una de las víctimas iraquíes merece justicia.

 

Los responsables de estos crímenes deben ser sometidos a la justicia.

 

Nos encontramos ante actos inmorales e ilegales, contrarios a los fundamentos sobre los cuales se basa el orden internacional de soberanía de Estado, paz y seguridad. Mientras que los tribunales de justicia internacional se encuentran cerrados ante el sufrimiento de aquellos agredidos por el imperialismo, nosotros intentamos, mediante esta causa, abrir un canal por el que la conciencia de la Humanidad pueda expresar su solidaridad con justicia a favor de las víctimas de los crímenes imperialistas.

مدريد: اليوم يتخذ المجلس التشريعي الأسباني قرارا بالحد من القوانين الاسبانية التي تسمح بالمقاضاة الدولية وذلك تأكيدا لقرار سبق اتخاذه تحت ضغط حكومات متنÙذة متهمة باقترا٠جرائم كبرى. قبل تغيير القانون، اقيمت بالأمس دعوى قضائية ÙÙŠ المحكمة الوطنية ضد أربعة من رؤساء الولايات المتحدة

الأمريكية وأربعة من رؤساء الوزراء ÙÙŠ المملكة البريطانية بتهمة التكلي٠باقترا٠و/أو التواطؤ على Ùˆ/أو اقترا٠جرائم حرب، وجرائم ضد الإنسانية والإبادة العرقية ÙÙŠ العراق.

وقد أقيمت هذه الدعوى القضائية ضد كل من جورج هـ. و. بوش وويليام ج. كلينتون وجورج و. بوش، وباراك هـ. أوباما، ومارجريت تاتشر، وجون ميجور، وأنتوني بلير وجوردون براون ، بواسطة عراقيين وابناء عراقيين وآخرين من المتضامنين مع الشعب

العراقي والمداÙعين عن حقوقه وعن القانون الدولي.

 

العراق: 19 عاما من التدمير المتعمد

إن التدمير المتعمد – أو الإبادة الحماعية – للعراق كدولة وأمة قد استمر Ù„Ùترة 19 عاما، جامعا ما بين أقسى نظام عقوبات أدى إلى موت أكثر من 1.5 مليون عراقي، من بينهم خمسمائة أل٠طÙÙ„ وبين حرب عدوانية أدت إلى

القتل العني٠لما يزيد عن مليون آخرين.

لقد تضمن تدمير العراق الاستهدا٠المتعمد لنظم المياه والصر٠الصحي، والعدوان على صحة السكان المدنيين. منذ عام 1990 قص٠العراق بآلا٠الأطنان من اليورانيوم المخصب، مما أدى ÙÙŠ بعض الأماكن إلى ارتÙاع، بلغ 600%ØŒ ÙÙŠ معدلات الإصابة بالسرطان واللوكيميا،

خاصة بين الأطÙال. ÙÙŠ كل من حرب الخليج الأولى وحملة "الصدمة والرعب" ÙÙŠ عام 2003ØŒ وهي الحملة الجوية التي حملت تهديدا معلنا "بالتدمير الشامل"ØŒ لم تميز عمليات القص٠بين الأهدا٠الحربية والأهدا٠المدنية، مما أدى إلى تدمير المدارس والمستشÙيات والمساجد

والكنائس والمناطق السكنية والمواقع التاريخية.

لقد تضمن تدمير العراق دعم وتمويل وتنظيم المجموعات الطائÙية والإثنية الساعية إلى تقسيم العراق إلى ثلاث أو أكثر مناطق طائÙية أو إثنية مدعومة بميليشيات مسلحة عملت على إرهاب الشعب العراقي. منذ عام 2003ØŒ أجبر 4.7 مليون عراقي، أي ما يوازي خمس السكان، على النزوح القسري. ÙˆÙÙŠ ظل الاحتلال امتدت عمليات الخط٠والقتل والابتزاز والتشويه لتشمل كاÙØ© أنحاء البلاد مستهدÙØ© الرجال والنساء وحتى الأطÙال والمسنين.

إن تدمير العراق تضمن التÙكيك المتعمد للدولة من خلال تشجيع أو رÙض وضع حد لعمليات النهب وبالمشاركة ÙÙŠ الملاحقات الأيديولوجية التي تضمنت الاغتيالات، والقتل خارج القانون والاعتقال الجماعي والتعذيب للبعثيين ومجمل الطبقة المتعلمة ÙÙŠ جهاز الدولة والأقليات الدينية واللغوية والعرب السنة مما أدى إلى انهيار كامل لكامل الخدمات العامة والوظائ٠الاقتصادية الأخرى إضاÙØ© إلى إشعال الÙتنة الطائÙية والÙساد المنهجي.

 

إضاÙØ© إلى كل ما سبق تعرض ميراث العراق الغني وتراثه الثقاÙÙŠ والتاريخي للتدمير المتعمد.

لقد سعت الحكومات الأمريكية والبريطانية المتلاحقة على تقسيم العراق واستخدام القوى العسكرية Ù„Ùرض حكومة عراقية ونظاما سياسيا مواليا للاحتلال سعيا إلى Ùرض تبعية العراق لاستراتيجيات الولايات المتحدة والمملكة المتحدة. لقد عملت تلك الحكومات وساهمت ÙÙŠ نهب الموارد الطبيعية العراقية وسعت إلى خصخصة ممتلكات وثروات الشعب العراقي.

 

البشرية ÙÙŠ خطر

 

إن هذا ما هو إلا مجرد تلخيص للÙظائع التي تحملها العراق بسبب أكاذيب لم يصدقها سوى الحكومات الجبانة والإعلام المتواطئ. ÙÙŠ عام 2003 احتشدت الملايين ÙÙŠ كاÙØ© أنحاء العالم ضد خطط الولايات المتحدة والمملكة المتحدة. بإصرارهما على تنÙيذ تلك الخطط شنت الولايات المتحدة والمملكة المتحدة حربا عدوانية، لم يحاسبا عليها حتى الآن.

 

لقد لعب كل شخص من الأشخاص المذكورين ÙÙŠ هذه القضية دورا محوريا ÙÙŠ التدمير المتعمد للعراق. Ùقد حرضوا Ùˆ/أو دعموا Ùˆ/أو كلÙوا Ùˆ/أو برروا Ùˆ/أو Ù†Ùذوا Ùˆ/أو تواطئوا أو تغاضوا عن هذا التدمير على أساس من الأكاذيب والمصالح الإستراتيجية والاقتصادية الضيقة وضد رغبة وإرادة شعوبهم. إن السماح لهؤلاء الأشخاص بالإÙلات من المحاسبة يعني إمكانية تكرار تلك الأÙعال ÙÙŠ أماكن أخرى.

 

من الضروري الآن أن تتم محاسبة الولايات المتحدة الأمريكية والمملكة المتحدة على جرائم الحرب والجرائم ضد الإنسانية والإبادة الحماعية ÙÙŠ العراق، ذلك أن:

كل ضحية عراقية تستحق العدالة

جميع المسئولين يجب أن يحاسبوا

 

إننا بصدد أعمال لا أخلاقية وغير قانونية، مناقضة للقاعدة التي استقر عليها النظام الدولي الخاص بسيادة الدول وسلامها وأمنها. وحيث أن نظام العدالة الدولي الرسمي قد أغلق أبوابه ÙÙŠ وجه معاناة المستهدÙين من قبل الامبريالية، Ùإننا بهذه الدعوى القضائية نسعى إلى Ùتح قناة تسمح لضمير الإنسانية بان يعبر عن تضامنه مع حق ضحايا الجرائم الامبريالية ÙÙŠ العدالة.
