Please see that this report gets in the record, and I'm sending it by

mail with attachments today. But just in case it doesn't get there in

time it's sent by email, and because reports can be printed out.

 

I am the founder of Mission Possible International, a non-profit

global volunteer force, operations in 39 nations, educating consumers

on the deadly reactions of aspartame and Splenda. In the case of

aspartame/NutraSweet/Equal/Spoonful, etc. I've taken the case

histories of aspartame for over 17 years and the cases on Sucralose

or Splenda since its been on the market. I have boxes and boxes of

case histories plus over 100 email boxes of cases - and they never

stop. Between these cases, the ones that come in by phone, fax, and

letter, and those I have spoken to as I lecture in other states and

countries, I probably have easily taken 50,000 cases of the sick and

dying. In fact, because of an email that made world news in 1999 my

computer crashed with 12,000 cases in one day.

 

First of all, aspartame is masquerading as an additive when, in fact,

its an addictive excitoneurotoxic carcinogenic drug that interacts

with virtually all drugs and vaccines because of damage to the

mitochondria or life of the cell. It is on the market illegally

because additives are suppose to be inert, and this is a drug.

 

On August 1, l985 the FDA's own toxicologist, Dr. Adrian Gross, told

Congress at least one of Searle's studies " has established beyond ANY

REASONABLE DOUBT that aspartame is capable of inducing brain tumors

in experimental animals and that this predisposition of it is of

extremely high significance. ... In view of these indications that

the cancer causing potential of aspartame is a matter that had been

established WAY BEYOND ANY REASONABLE DOUBT, one can ask: What is the

reason for the apparent refusal by the FDA to invoke for this food

additive the so-called Delaney Amendment to the Food, Drug and Cosmetic Act? "

 

The Delaney Amendment makes it illegal to allow any residues of

cancer causing chemicals in foods. In his concluding testimony Gross

asked, " Given the cancer causing potential of aspartame how would the

FDA justify its position that it views a certain amount of aspartame

as constituting an allowable daily intake or 'safe' level of it? Is

that position in effect not equivalent to setting a 'tolerance' for

this food additive and thus a violation of that law? And if the FDA

itself elects to violate the law, who is left to protect the health

of the public? " Congressional Record SID835:131 (August 1, l985)

 

So here you see not only is aspartame masquerading as an additive but

that the FDA knew it caused cancer over a quarter of a century ago,

violating the Delaney Amendment which forbids putting it in food. As

the FDA toxicologist admitted, they should not have been able to set

an allowable daily intake.

 

Two decades after this congressional hearing Dr. Morando Soffritti in

England did the prestigious Ramazzini Study confirming FDA's records

that aspartame is a multipotential carcinogen.

He then did another study showing it only takes a small amount of

aspartame to cause cancer and if a pregnant woman uses it and the

baby survives her offspring can get cancer.

By way of introduction, background, training, and experience, I have

been a licensed Texas Attorney since April 1971. I began my legal

career as a Briefing Attorney to U.S. District Judge John H. Wood,

Jr. (Deceased), then served as an Assistant U.S. Attorney for The

Western District of Texas, and am the Former President/CEO and Senior

Managing Shareholder of the 18th largest lawfirm in San Antonio,

Texas, as listed in the 1995 " Book of Lists, " " San Antonio Business Journal. "

 

My biography has been published for the past 15 years in " Who's Who

in American Law. " I am now retired from the active practice of law,

and am fully engaged in the ownership of a Health & Wellness

Distributorship with large international business operations. I

continue to stay abreast of health related issues involving things

which are both beneficial and harmful for human consumption, and have

been featured on an ABC TV Program involving " Dangerous Foods, " in

health related books, and in a recent full length film, " Sweet Misery

in a Poisoned World, " involving the great dangers of aspartame to humans.

 

As a briefing attorney to a U.S. District Judge, and as an Assistant

U.S. Attorney with the U.S. Department of Justice, it was my job to

interpret the meaning, application, and enforcement of federal

Statutes and Regulations, which frequently required referring to the

Congressional History of Federal Legislation by researching the

history in the " Congressional Record. " This also frequently entailed

researching State Statutes.

 

I have reviewed the New Mexico Food Act (25-2-1 to 25-2-19 and

25-2-20 NMSA l978) on adulterated and poisonous foods. It is a

strong, clear law with its criminal prosecution provisions for

violators. It is quite clear in its meaning and in its intent, and is

not hard to understand or interpret.

 

The said Statute provides that: A food shall be deemed to be

adulterated, (1) if it contains any poisonous or deleterious

substance which may render it injurious; (2) if it contains any added

poisonous or added deleterious substance which is unsafe, and (3) if

it consists in whole or in part of ... decomposed substance, or if it

is otherwise unfit.

 

Under New Mexico law, inasmuch as aspartame clearly and unequivocally

decomposes and adulterates, this is an open and shut case. You

clearly have the right as well as the obligation to ban aspartame for

the health, safety, and welfare of your citizens.

 

The Bottom Line is: (1) Aspartame is unsafe and adulterated, and is

indeed dangerous to the health, safety and welfare of the citizens of

The State of [board, not agency] New Mexico, and (2) your Agency is

empowered to and should ban aspartame from your State in order to

protect and to preserve the health, safety and welfare of the

citizens of The State of New Mexico.

 

DISCUSSION

 

In Statute 25-2-15, NMSA, the authority to promulgate regulations for

the efficient enforcement of the New Mexico Food Act is vested in your Board.

 

Therefore, the EIB has the right to ban aspartame. For example, in

Minnesota, U.S. District Judge, Hon. James Rosenbaum, affirmed the

right of a state to protect its citizens health, despite corporate

claims of being protected by the FDA approval of their products and

that nothing in the act which created the FDA was intended to preempt

any state tort law or consumer protection statute or certainly the

statutory powers given to the New Mexico EIB in statutes and in the

New Mexico Administrative Code.

 

A recent example of FDA approval of dangerous substances is the Vioxx

situation, wherein 55,000 US citizens were found to have died of

causes associated with the ingestion of Vioxx. Don't let the much

worse situation of aspartame poisoning continue in New Mexico, when

you have the very clear right and very clear power to ban it from use

in the State of New Mexico.

 

This could be the first step in removing what has been described by

highly credentialed medical doctors as a " Worldwide Plague. "

 

Aspartame is a prime example of an adulterating/poisonous substance

forbidden by this law and should be banned now. The said New Mexico

Statute is very similar to the Federal Statute. The May 7, 1985

United States Senate Congressional Record recorded the long, detailed

protest of the National Soft Drink Association against aspartame

specifically because of its unique instability. This does not bear

repeating verbatim in this memo, however, the following salient

excerpt states: " Specifically, Searle did not meet its burdens under

section 409 of the Federal Food, Drug and Cosmetic Act, 21 U.S.C. 348

( " FDC Act " ) to demonstrate that aspartame is safe. "

 

In fact, the FDA's own Senior Toxicologist, the late Dr. Adrian

Gross, who took part in on-site investigations at Searle, said the

studies carried out by Searle to show the safety of aspartame were

" to a large extent unreliable. " He said " at least one of those

studies has established " beyond any reasonable doubt " that aspartame

is capable of inducing brain tumors in experimental animals and that

this is of extremely high significance. " Gross also testified before

Congress that because aspartame was capable of producing brain tumors

and brain cancer, FDA should not have been able to set an allowable

daily intake of the substance at ANY LEVEL. Congressional Record

The FDA's own report admits to 92 documented symptoms triggered by

aspartame from four types of seizures to coma and death. An 1138 page

medical text, " Aspartame Disease: An Ignored Epidemic, " by H. J.

Roberts, M.D. documents symptoms and diseases triggered by this

deadly neurotoxin. See more at:

In the Trocho Study (Trocho C., Pardo R, et al. Formaldehyde derived

from dietary aspartame binds to tissue components in vivo. Life

Sciences 63: 337-349, l998) it was demonstrated that following

aspartame ingestion, significant amounts of formaldehyde accumulate

in the tissues. Russell Blaylock, M.D., discussing this study said

that formaldehyde is known to bind strongly to proteins and nucleic

acids, forming adducts that are extremely difficult to eliminate

through normal metabolic pathways.

 

Ergo, aspartame was clearly in violation of the federal adulteration

law and was illegally added. By admission of the National Soft Drink

Association, " Section 402 of FDC Act 21 provides a food is

adulterated if it contains, in whole or in part ...a decomposed

substance, or if it is otherwise unfit for food. " This is the same

language as that of the New Mexico statute, which clearly gives The

State of New Mexico and your Board the right and the power to ban

aspartame in New Mexico.

 

The FDA's own studies of aspartame clearly demonstrate that aspartame

breaks down in beverages in temperatures over 86 degrees Fahrenheit,

into aspartic acid, an excitotoxin and formaldehyde, a deadly

neurotoxin. This in fact occurred in the Gulf War, as pallets of Diet

Coke were left sitting for days in the hot desert sun, and the

temperatures reached 125 degrees Fahrenheit. I repeat: There are in

fact 92 medical symptoms listed in the FDA's own records.

 

The above referenced medical text written by Dr. H. J. Roberts, M.D.

(chosen by the editors of a national medical journal as " The Best

Doctor in the U.S. " ) clearly makes the case against aspartame, and

the fact that aspartame decomposes and adulterates. This fact is well

documented in Dr. Roberts heavily footnoted and annotated 1138 page

medical text and needs not to be repeated verbatim in this brief

discussion. As we say in law, Res Ipsa Loquitor, " The Thing Speaks

For Itself. "

 

There is much more than a " smoking gun " here. There are in fact

millions of lives ruined, and deaths that have occurred, as a direct

and proximate cause of ingestion of aspartame since it was

introduced. I myself am a victim of aspartame, and have had 2

pituitary adenoma (brain tumor) surgeries and radiation therapy. I

have no doubt that these were directly and proximately caused by my

heavy aspartame ingestion.

 

The banning of aspartame is not only well within your powers, but is

in fact a long overdue service to New Mexico's consumers who are

ingesting this product unknowing its toxicity.

 

You are to be commended for having moved this rule change along this

far to take this much needed step of banning aspartame in New Mexico

in order to protect the health, safety and welfare of the citizens of

The State of New Mexico. Other states will follow New Mexico's example.

Dear Ms. Dillingham and Members of the EIB:

I spoke, along with Dr. Grant LaFarge, to the EIB previously about

aspartame. I understand you now have to consider the legal issue of

whether the EIB has the authority to regulate this neurotoxin based

on the current statutes that are in place. I am a physician, not a

legal scholar, but I have reviewed the statutes and it is very clear

that the EIB does have this regulatory authority.

 

I dare say the decision you reach on October 4th will be a very

important one and I will leave my comment on the subject at that, but

I want to tell you a very relevant personal story.

 

I once knew Arthur Hull Hayes, Jr, M.D., the FDA Commissioner who

approved aspartame back in 1981, over all of the objections of the

internal boards and evaluations of the FDA at that time. Dr. Hayes

flew out to San Francisco to interview me when I was applying to

medical school, and it was because of Dr. Hayes that I went to Penn

State where he was teaching in the mid-70s.

 

I remember when Dr. Hayes was chosen to be the head of the FDA, when

he green lighted NutraSweet, despite evidence that it was an

extremely harmful neurotoxin, and I remember that he resigned in 1983

when it was discovered he had been, in effect, taking bribes from

pharmaceutical companies. Then he went off to work at the PR firm for

the very company that owned the patent for, manufactured, and sold

aspartame! As a former student of his, it was clear to me that his

entire medical career was disgraced, and to this day he refuses to

even talk about his role in getting aspartame approved.

 

The system is broken -- those governmental organizations, such as the

FDA, that should be working for the people of our country, have been

turned into corrupt trade organizations by the very corporations they

have been mandated to regulate. This has been going on for decades

now. We are ruled, in a sense, by a corporate plutocracy at the

Federal level. Only the individual states have the ability, at this

eleventh hour in our democracy, to act in accordance with the

principles of our founding fathers.

 

I am not waxing poetic here, but I must point out very clearly to all

of you as members of the New Mexico Environmental Board that your

decision on the 4th is that important, and that the very nature of a

government of the people, for the people, and by the people, is in

your hands. Please do not cave in to pressures being brought down

about you so that corporations can continue to sell a poison!

 

I have testified in front of a Congressional hearing on a related

matter, but the hearing that I attended that made the biggest

impression on me was the one I attended as a boy. As I youngster I

watched Congress decide whether to put warning labels on cigarette

boxes. The year was 1965! I bring this up because the influence of

the tobacco industry on our government is still pervasive and

endemic. In a real sense, we gave away our federal government first

to the tobacco industry and then to all those that have followed in

the tobacco industry,s footsteps. They have all done well because we

let many profit by poisoning, polluting and stealing from us by not

demanding our rights and sovereignty in these areas. But this will

change if you can be the vehicle of this change by merely following

the existing statute that empowers the EIB to prohibit the use of

this neurotoxic food additive henceforth in New Mexico.

I might add that this Board voted twice for a hearing and then

Ajinomoto's attorneys came in behind closed doors which is illegal

and stopped the hearing. I hope California will not put up with such

shenanigans.

So you're talking about a product that is masquerading as an additive

and is a deadly drug that if approved as a drug would never have been

allowed to stay on the market with the deadly reactions and death, a

drug that also violates adulteration laws and even Interstate

Commerce because its illegal to ship an adulterated product for sale.

Further it's a deadly carcinogen which violates the Delaney Amendment.

 

The next thing one would ask is how did such a deadly product get

approved in the first place. Here is that information. The FDA knew

immediately. back in the l970's it was a poison. The original

manufacturer, Searle, couldn't take a poison and make it show safety

so they got caught with their pants down doing such things as

filtering out neoplasms so the FDA wouldn't see them, and removing

brain tumors from rats, then putting them back in the study and when

the rats died they resurrected them on paper. So the FDA asked that

Searle be indicted for fraud. Showing you the power of the aspartame

industry both U.S. Prosecutors Sam Skinner and William Conlon hired

on with the defense team and the statute of limitations expired. But

the FDA had no intention of allowing this deadly poison to be on the

market and revoked the petition for approval. Here it is:

Don Rumsfeld was CEO of Searle at the time, put there because of

Searle's problems, to clean up the mess and get aspartame on the

market. Talking to former employees they told me " everyone knew

aspartame was poison and people thought the office would be closed

down " . The Bressler Report shows you some of the things Searle did:

However, this is not the worst of the report as there is 20% missing,

two mice studies that were conveniently removed when the FDA re-typed

the report. The FDA thought it was so bad and so poisonous they

didn't want anyone to know how bad aspartame really is, which doesn't

say much for the FDA even though they tried to prevent approval. Dr.

H. J. Roberts even asked his congressman to get the remainder after

talking to Jerome Bressler but the FDA told the congressman it was

confidential and they weren't going to release it even though its

public record. So you have a corrupt FDA. I even attempted to get

this material through FOIA but first it was confidential and then it

was destroyed.

Pretty pathetic. But the Bressler Report as stated above shows what

Searle did to try and hide the facts.

 

Don Rumsfeld also knowing it was poison said he would call in his

markers and get it approved anyway. What were those markers?

President Reagan had promised to nominate Rumsfeld as Vice President

and instead used George Bush. So Rumsfeld felt Reagan owed him a

favor. The day after he took office he appointed Dr. Arthur Hull

Hayes to be FDA Commissioner to over-rule the Board of Inquiry. The

day after FDA had revoked the petition Searle sued to keep FDA

Commissioner Jere Goyan from signing that petition into law. In the

meantime, what to do with Jere Goyan who his wife said Rumsfeld had

said had to go, because if he signed the petition aspartame would

never have gotten on the market and millions of people the world over

would be alive today who are now dead from this deadly chemical

poison. Here's what happened. A member of the Reagan Transition Team

called Jere Goyan at three AM and fired him. Here's a letter from his

wife confirming this:

President Reagan then wrote an Executive Order making the FDA

powerless to do anything about aspartame until Arthur Hull Hayes got

Then the Executive Order which by law must be public record was

expunged so nobody could see it. Don Rumsfeld should be put on an

iceberg and sent out to sea for the murders of all those who have

died from aspartame, and those who are disabled the world over.

 

Once Arthur Hull Hayes took office he over-ruled the Board of Inquiry

and then went to work for the PR Agency of the manufacturer and has

refused to talk to the press ever since. He was on contract for

$1000.00 a day for ten years. Quite a reward for getting a poison on

the market that would kill millions and because of its addictive

nature would make the company billions. One article says Hayes over

the years was never at Burston Marstellar but about 15 days.

 

In l983/84 Searle decided to see just how fast aspartame kills and

did studies in 6 countries. According to translator N. Vera people

were sacrificed from poor villages. Some died. The studies showed

aspartame hardens the synovial fluids which accounts for the horrible

joint pain many times given the junkbucket diagnosis fibromyalgia so

many aspartame victims experience. Some got brain tumors and some

seizures. They showed aspartame destroys the brain and the central

nervous system. Her affidavit also shows that the pregnant woman lost

her baby, hemorrhaged and disappeared. They were never published, of

course. Searle sold to Monsanto and Rummy got 12 million making his

fortune for getting a deadly poisoned marketed for human consumption.

aspartame was listed with the pentagon in an inventory of prospective

biochemical warfare weapons submitted to Congress. So instead of

poisoning the enemy aspartame was used to poison consumers in the US

and eventually in 100 countries of the world. Monsanto eventually

sold to Ajinomoto, Merisant (a group of Monsanto managers), Michael

Dell and Child's. Ajinomoto owns the major part of the aspartame industry.

 

When aspartame was originally approved immediately people began

getting seizures, being diagnosed with MS, fibromyalgia, lupus and

many other diseases and symptoms. The FDA listed 92 documented

symptoms including the ultimate " symptom " death.

Senator Howard Metzenbaum immediately tried to get congressional

hearings. Senator Orrin Hatch refused until l985 and he was given

money by Monsanto. It was because of his influence it is believed

that a bill by Senator Metzenbaum never got out of committee. It

would have put a moratorium on aspartame and had NIH do independent

studies on the problems being seen in the population such as

seizures, what it does to the fetus, behavioral problems and drug

So because of Monsanto's influence and paying senators nothing

happened. There was another congressional hearing in August, l985

Dr. Jacqueline Verrett, a former FDA toxicologist, and member of an

FDA task force that investigated the authenticity of research done by

Searle to establish the safety of aspartame, said she believes the

original aspartame studies were " built on a foundation of sand. "

U.S. Senate Committee on Labor and Human Resources, regarding

" NutraSweet Health and Safety Concerns. " (November 3, l987)

 

She testified in front of a U.S. Senate hearing in 1987 that flawed

tests conducted by Searle -- used as the basis of FDA approval - were

a " disaster " and should have been " thrown out. " She said she believed

the studies left many unanswered questions about possible birth

defects and the safety of aspartame. Verrett said the team was

instructed not to be concerned with, or comment upon, the overall

validity of the study. She said a subsequent review discarded or

ignored the problems and deficiencies outlined by her team's original

report. She said, " serious departures from acceptable toxicological

protocols " that her investigative team noted in the reevaluation of

these studies were also discounted.

 

She warned that any of the improper practices would compromise and

negate a safety study of a food additive. Verrett concluded the data

in the study was worthless, and the safety of aspartame and its

breakdown products have therefore not been determined. She emphasized

that aspartame exists in the marketplace without basic toxicity

information. She said there are no data to assess the interactions

with DKP, excess phenylalanine, other aspartame metabolites,

additives, drugs or other chemicals.

 

In her testimony, Verrett elaborated on DKP problems which aspartame

breaks down to, including significant increases of uterine polyps and

changes in blood cholesterol. DKP is formed when liquids in

particular are pre-sweetened with aspartame. The production of DKP is

The troops have many of the problems so notorious with aspartame such

as Lou Gehrigs and MS, brain tumors, memory loss, joint pain, etc.

Because aspartame is a poison, a chemical hypersensitization agent it

The FDA agreed. Today there is no warning about birth defects on the

label and ADD, ADHD, Tourettes and autism and such are epidemic. Even

Dr. Louis Elsas testified before Congress in May, 1985, who at the

time was a Pediatric Professor at Emory University, genetics. Back on

November 3, l987 he told Congress: .. " I am a pediatrician, a

So when you wonder about birth defects are so epidemic its because

70% of the population are using aspartame. It completely destroys

induces male sexual dysfunction. Beyond this, aspartame disrupts

fetal development by aborting it or inducing defects. And if a live

child is born aspartame may have heinously damaged the DNA of the

baby, cursing future generations.

 

Talking about future generations, as I mentioned, Dr. M. Soffritti,

did the prestigious Ramazzini Study in Italy in 2005 and showed what

the FDA knew over a quarter of a century ago, that aspartame is a

multipotential carcinogen. Besides brain tumors aspartame triggered

thyroid, pancreatic, ovarian, uterine, testicular and mammary tumors

for starters. The aspartame industry did everything possible to rebut

this million dollar prestigious independent study peer reviewed by 7

The aspartame industry knew they had had it and they went all out to

refute the study. The FDA and the European Union were asked about the

seriousness of aspartame causing cancer. Would you believe what their

excuse is for not removing it from the above New York Times article:

Food companies and consumers around the world bought about $570

million worth of it last year. New regulatory action on aspartame

with it. " So neither the FDA nor the European Union were the least

bit interested in the health of the world in using this carcinogen

but were concerned about the finances of the manufacturers, and this

is with full knowledge that aspartame is a deadly poison. This is an

not only is aspartame a multipotential carcinogen but even in small
