I was unaware of the sentencing or the outcome of this trial.

So i was thinking that there might be others that might also want this

information.

The Jim Folsom Trial - Update

 

 

This article is about James Folsom, who was a manufacturer and distributor

of the BioSolutions/Global Wellness Plus, Rife-type, bio-resonance

instruments based inSan Diego, California and has been imprisoned for marketing

Regular readers of the Rife Forum and this newsletter will have heard how

Jim Folsom, one of the venders of the Global Wellness frequency therapy

units, has been prosecuted by the FDA. Jim challenged the FDA because the

devices he was marketing are eligible to be marketed in the USA, according to

the grandfather clause of the May 28, 1976 Congressional – Cosmetic, Food

and Drug (Devices) Act (1976 CCFD Act) for such devices in use before 1976.

 

Jim was sentenced to 51 months in prison starting April 2nd, with time

served being taken into account. There was also a $250,000 fine and 3-year

probation served. The Judge also approved the destruction of his devices,

including an original Rife frequency device, which was the physical proof that

such “rife†devices were used before 1976. However, the destruction will

not take place until after the appeal stage.

The sentencing was spread over two days as time was insufficient on the

first day. After much deliberation over relevancy of Sentencing Guidelines,

they were deemed not usable. Also the well worn issue of victims got put

down as the Judge stated how many of the letters mentioned actual benefits and

no vulnerable victims as such, no stealing. He also said â€providing

product they wanted.†The Judge also stated the FDA had not kept pace with

alternative medicine – The FDA needs to catch up.

 

The final outcome was 51 months starting April 2nd with time served being

taken into account. There was also a $250,000 fine and 3 year probation

served.

 

The Judge did ok the destruction of evidence but it is to be held until

through the appeal stage. An appeal will be filed as soon as possible.
