Comments on FDA Guidance for CAM Products and Regulation

 

FDA Regulators Using Legal Trickery to Kill Alternative Procedures and

Products

 

 

 

The FDA is using legal maneuvering to end your access to natural health

products (like vitamins, minerals and herbs) and natural health therapies of

all

sorts. Again. This time, their ploy is to declare the therapies are

" Medicine " so any non-physician who uses them will be practicing medicine

without a

license. Since these practices are " Medicine " , any products used would be

untested drugs and therefore forbidden.

 

 

 

Your Comments are Vitally Important

 

 

 

Public, professional and industry comments are being accepted on the FDA

proposal to " capture " alternative procedures and products as " medicine " and

then

make them illegal. The history of these repressive attacks by the FDA makes

it clear that public outcry, IN HUGE NUMBERS, is the only effective tool that

natural health supporters have to change this disastrous outcome. Comments

will be accepted until April 30. By contacting everyone you can reach to ask

for their participation in this comment campaign, we can kill this assault on

personal health freedom.

I looked into this matter, and as I suspected, it is a lot of fuss over nothing.

The person who sent it out is trying to promote her organization by creating

hysteria, acting like a hero, and collecting donations. It is a complete misuse

of the public trust. I spoke with my contacts in the American Herbal Products

Association about the FDA guidance document in question. It is simply a

re-stating of existing regulations. They said that FDA has received thousands of

emails, and they can't figure out what all the fuss is about. Nobody is going to

lose access to herbs, vitamins, and minerals as a result of this document. There

are some sections that do require comment, as is usually the case, and I will

post AHPA's comments to FDA when they are completed.

As I suspected. This is not the first time these organizations have

cried wolf. . .it would be nice to know when an event of actual

concern was taking place in terms of regulations, so we could respond

effectively.

I have heard the view before and I hope it is true.

 

I don't pretend to know the truth about codex, but if there is a

" conspiracy " to put one over on people, it would make sense to me that they

would

deny any offense and try to make the people complacent.

 

They could potentially do that by suggesting that FDA doing anything

that would hurt you and it's just those extreme self serving people who are off

track.

 

Given the FDA track history, I don't trust anything they have to say

about anything. Although to give them some credit, I am sure they stumble on

to

the truth occasionally, accidentally.

 

I may be a little extreme in that view though.

There is a LOT of hyperbole out there re: CODEX specifically and herb

regulation generally.

 

CODEX would only take precedence over US law if the World Trade

Organization (WTO) determined that US law was a “barrier to trade.”

If the US had stricter regulation of nutritional supplements than

CODEX, it could be forced to relax its regulation in order to permit

CODEX-compliant supplements to be imported.

 

US regulation of supplements is significantly less strict than

CODEX. Because CODEX-compliant supplements can currently be imported

into the US, there is no barrier to trade, and therefore, no basis

for challenging US law (DSHEA) which, barring the basis for a WTO

barrier-to-trade challenge, would have to be changed by an act of

Congress.

 

My assessment is that CODEX is something to keep an eye on but

nothing to panic about.

 

As for the recent Draft Guidance Document circulated by FDA, I agree

with others on the list: This is no cause for concern. It is simply

a non-binding restatement of existing laws and regulations. It is

nothing new but does reaffirm that FDA has regulatory authority over

dietary supplements including herbs. Again, absolutely nothing new.

 

There are really serious issues related to our access to and use of

herbs. CODEX and the recent FDA Guidance Document are not currently

among them. They distract us from the real issues.
