Acupuncturist jailed for three years for filming his patients by Tomas Mac Ruairi A TAIWANESE acupuncturist who secretly filmed partially-clothed female patients has been jailed for three years by Judge Kieran O'Connor at Dublin Circuit Criminal Court. Palden Carson, with a former address at Walker's Cottages, Ranelagh, Dublin and later at 29 Mauratina Buildings, 4 Jardine Road, London E19 WB, England, pleaded guilty to sexually assaulting two patients at his Ranelagh clinic on dates in 1996. Judge O'Connor directed that £15,000 compensation offered by Carson to his victims should be divided equally between them. The cheques were handed over in court by defence solicitor Robert Eager. Defence counsel, Patrick Gageby SC, told Judge O'Connor the £15,000 offered the victims was not meant as compensation, but, was an earnest sign of Carson's remorse. It didn't affect their right to bring civil claims. The court heard at least one of the victims was instituting civil litigation. Judge O'Connor also revoked an earlier order prohibiting publication of the 47-year-old single man's name and address. The victims are in their early twenties and their identities cannot be revealed without their authority. Prosecuting counsel, Tom O'Connell BL, said the only grounds on which the court had the power to prevent the media naming Carson was if by doing so any of the victims could be identified. Carson had more than 1,200 patients so that didn't arise. Judge O'Connor directed that Carson's sentence was to date from February 7 last, when he was taken into custody on an extradition order and was to be suspended from December 14 next, when he is to leave Ireland. If he didn't leave Ireland voluntarily he would serve the full sentence. Mr Gageby (with Michael O'Higgins BL) said Carson was a naturalised Irish citizen, but, would leave the country as soon as possible. Judge O'Connor told Carson: " We don't want your type in this country. You were welcomed here and became a citizen, but, you behaved despicably and abused the trust placed in you " . Throughout the sentence hearing, Carson's brother sat behind defence counsel dressed in the ceremonial robes of an Oxford graduate of philosophy and with variously his left and right white-gloved hand raised. Mr Gageby told Judge O'Connor that his client's brother wanted to address the court, but, as defence counsel he had decided he wasn't going to call him again, because, he didn't consider he had anything useful to add to what he said at a previous hearing. Judge O'Connor told Carson it was fortunate for him that he pleaded guilty, or he would have imposed the maximum five years sentence permitted by law for this offence. He accepted Carson was a good acupuncturist, but, he had brought the work into disrepute by his despicable abuse of trust. " I am surprised you have no previous convictions, because, it appears to me you have some form of repressed sexual desires which you fulfilled in the way described in this case " , said Judge O'Connor. At an earlier hearing in June, the defendant's brother - a qualified medical specialist - said he wanted to apologise on behalf of the family to the victims. His brother had brought disgrace on himself and the family. He said the family originated in East Tibet, but, moved many years ago to Taiwan, where they were reared. Their father was now elderly and quite ill in Canada, but, was formerly a US Airforce B52 bomber pilot in World War II. The court heard Carson qualified as a doctor in Taiwan, but, failed 11 times in surgery examinations in Ireland. He came here in 1984 and achieved a high reputation as an acupuncturist, with a client list of some 1,240. Detective Sergeant George McGeary said Carson made video recordings of naked female patients and could be seen on some of the tapes masturbating himself. A total of 12 different females were recorded on two video-tapes handed to one victim's family by Carson. Some of the women identified on videos declined to assist in the garda investigation. The women were unaware they had been video-recorded by Carson, who had them wear vibrating goggles with opaque glass, claiming this would relax them for the needles used in acupuncture. Det Sgt McGeary said the case might not have come to light but for the fact that one of the two victims observed a camcorder in Carson's hand through a gap in the goggles. Carson had first explained different matters about the body and acupuncture to this woman. He told her to undress and put her lying on her stomach, telling her massage was part of the treatment. He first massaged her back with oil and then pulled down her panties and massaged her buttocks. He then turned her over, put the goggles on her and proceeded to massage her breasts, groin area and her inner thighs. After he inserted the acupuncture needles all over her body, his doorbell rang and it was when he returned that she saw the camcorder in one of his hands and an incense type of stick used to heat needles in the other. He drew the stick' up and down her body from her breasts to her groin area. Det Sgt McGeary said the woman was extremely distressed and was " in a most awful state when she reached her mother. " She lodged a complaint with the gardaà some hours later. Two days later, Carson was interviewed by the now-retired Det Sgt Brendan McGlynn. Carson went immediately to that victim's family begging forgiveness and asking them to withdraw the complaint. He also handed over two video-tapes, though the victim couldn't identify herself on either of them. While in the woman's house, Carson became hysterical and banged his head several times off a door as well as slapping his head forcibly with his hands while repeating: " I am a very bad man " .
