My mother tried to sue johns Hopkins and her trial was in Baltimore- well, they own that city and they hired the sharkiest of lawyers and of course she got nothing- except for a bill for the costs of the trial!...It amazes me that someones life can be altered permanantly, and extreme pain can be experienced at the fault of a surgeon- and then not be able to sue for malpractice and win- AND then people can sue mcdonalds and get millions because they spill coffee on themselves!!!! I also am sure my Prof friend will end up with nothing in a law suit but a bill. I base that on the rallying of the hospital and the fact the hospital attorney visited her while she was in the hospital recovering from the sponge surgery. Personally, I thought that was very nervy, but he was very clear about what they were willing to do and what they were not willing to do. She decided to try to fight them in court.
