The criminal case against Dr. Sophie Chen was resolved today. This afternoon

Dr. Chen entered a " no contest " plea to an adulterated food regulatory

misdemeanor. This is the same type of violation that a market or restaurant

would face if their food, unbeknownst to them, turned out to be contaminated

in some way. By resolving the criminal case in this manner, Dr. Chen will

now be able to devote her time and energy to her research, and contesting a

number of frivolous civil lawsuits, rather than spending the next year and

all of her personal savings contesting a groundless criminal case.

 

The fact that the District Attorney agreed to a settlement whereby he would

dismiss the case if Dr. Chen and her associates would plead " no contest " to

such a charge and pay a fine to reimburse the state and his office for the

costs of the investigation demonstrates that the District Attorney finally

recognized the true facts of the case, that is, that the entire PC-SPES

contamination issue was overblown and that whatever minor contamination may

have occurred, unintentional. In referring the matter to the District

Attorney, the California Department of Health Services and others did a

great disservice to the District Attorney, the public, and those who suffer

from late stage prostate cancer, by misinforming them as to the alleged

dangers of PC-SPES.

 

The criminal case against Dr. Chen was an outrage. It should never have

been filed. The investigation by the California Department of Health

Services was superficial and their science flawed. Dr. Sophie Chen, the

author or co-author of twenty scientific articles and books, and over a

dozen patents, is a dedicated scientist whose work has benefitted thousands

of late stage prostate cancer sufferers. For thousands of prostate cancer

sufferers PC-SPES worked despite the alleged contamination problems the

company encountered. Even California Department of Health Services officials

have now publicly admitted that contamination is a common problem with

Chinese herbs and patent medicines. In addition, the lead investigator in

the case recently admitted under oath that there was no evidence that Dr.

Chen or any one else in the company ever intentionally adulterated their

products and that any contamination must have occurred in China.

 

 

Dr. Chen has always acknowledged that BotanicLab, the company that imported

the herbal compound, encountered minor quality control problems with its

Chinese suppliers. Moreover, as soon as independent tests revealed possible

contamination, the company recalled the product. However, new more

sophisticated tests in the UK have confirmed that most of what appears to be

the synthetic or pharmaceutical drugs alleged in the criminal complaint are

really natural phyto-chemical compounds that have a similar chemical

signatures. Therefore, there is now some question as to whether there was

ever any contamination. This is also confirmed by the fact that earlier

testing by the FDA failed to detect any of the alleged contaminants.

 

The real victims in this matter are the men who have suffered and died

because of the recall of PC-SPES. Whatever contamination may have occurred

was minuscule at best and did not affect the efficacy of PC-SPES No one has

ever died or experienced any significant ill effects from taking PC-SPES as

directed. However, thousands of men benefitted and had both their lives

extended and the quality of their lives improved.

 

If there were any crime here, it was the " success " certain people involved

in a number of civil lawsuits against Dr. Chen and her associates had in

pressuring the California Department of Health Services and the District

Attorney into a prosecution that resulted in the recall of PC-SPES.

 

Both historical and current testing of PC-SPES demonstrates that PC-SPES,

even with the low levels of unintended contamination that may have occurred,

was and is effective at reducing PSA levels and prolonging the lives of late

stage prostate cancer sufferers, particularly those who failed conventional

hormone therapy. Some of the best evidence that PC-SPES was effective and

Dr. Chen's research valid is the fact that as soon as the state forced the

recall of PC-SPES, others copied her formula, despite the fact that it is

protected by a number of United States patents. As a result, there are now

at least ten " copycat " products on the market.

 

As a pioneer in the recently " rediscovered " field of phyto-therapy and

because of the complexity of botanical mixtures, Dr. Chen has consistently

urged the medical and research community to devise new protocols and

standards for testing botanical extracts, and the still little understood

synergistic effect of multiple phyto-compounds. As a dedicated scientist

who has spent her entire adult life searching for a cure for cancer and

other debilitating diseases, Dr. Chen will continue her research and wishes

to thank her many supporters who have stood by her during this difficult

time.
