opposition group working diametrically against the efforts of IAHF and Allied

NSF's long standing pattern of attempting to Hijack the health freedom

movement in order to divert dietary supplement consumers into dead ends through

skillful use of spin, disinfo, and " tell us what we want to hear " in an effort

to

build a following has been thoroughly exposed by IAHF, the National Health

Federation, the Dr.Rath Foundation, and other Allied Groups for the past several

In their most recent barrage of disinfo, NSF, which continues to perpetuate

IAHF's opinion. Its been, and from the look of things still IS being used by

NSF to try to DIVERT ATTENTION AWAY from the need to kill or amend S.1082 and

Ready for Some Great News?

 

Although the FDA denied our request to extend the comment, failed to update

its site or its comment tally, extended the comment period and then resinded

the extension (!), our collective voice won us a huge victory in Congress today.

Because we rallied behind our health freedom and access to natural health

products, every member of the Senate voting today heard us loud and clear and

acted -- without a single dissenting voice -- to protect our health freedom!

S.1082 - Enhancing Drug Safety and Innovation Act of 2007 - from Sen. Durbin.

It appears that Congress heard our concerns! Hundreds of thousands of

messages to FDA no doubt reverberated through the halls of Congress. The

amendment was adopted by the Senate 94 to zero.

 

Sec. X08. Rule of Construction

Nothing in this title (or an amendment made by this title) shall be construed

to affect--

(1) The regulation of dietary supplements under the Dietary Supplement

Health and Education Act; or

(2) The adverse event reporting system for dietary supplements created

under the Dietary Supplement and Nonprescription Drug Consumer Protection

Act.

 

Like many victories in Congress, you hardly ever get everything you want.

Leading supplement industry lawyer, J. Emord, originally proposed exempting

all " foods " from the new law (Counsel stated: " It is a fundamental tenet of food

and

drug law that foods and food ingredients are presumed to be safe and have to

be established to be adulterated only if they present a significant or

unreasonable risk of illness or injury. " This approach would have offered even

greater protection for natural products, but we are grateful that enough members

of

Congress heard the loud shout from the public and responded so quickly to at

least protect DSHEA products -- the power of Internet politics at its best.

announcing a non existent " victory " NSF is clearly trying to get people to sit

on their hands and not keep fighting back! NSF did the same exact thing when

IAHF and Allied groups attempted to kill CAFTA, recognizing the tie in between

the trade agreement and Codex- at that time they generated no less than SEVEN

IAHF and Allied groups are continuing to try to do the following with regards

to S.1082:

 

A) Get Emord's amendment into the bill, removing the terms " Foods " and " Food

Ingredients " from the section of this voluminous bill on the Reagan-Udall

Foundation for the FDA is the only sure fire way to even PARTIALLY protect

ourselves from this horrible piece of legislation which creates a pharmaceutical

development company literally INSIDE the FDA. We have one huge campaign focused

right now on Senator Enzi via Nature's Sunshine distributors made possible via

Clinton Miller who are petitioning him in huge numbers, and a second campaign

to try to get Senator Coburn to take up our amendment.

 

B) We need to DEFEAT the Cochran Amendment on Monday when it comes up for a

vote because it would DERAIL the Dorgan amendment which passed wednesday. The

Dorgan amendment allows for the importation of foreign drugs. Bush has vowed to

veto the bill if the Dorgan amendment is in it, and we WANT him to veto the

bill so we don't want the Cochran amendment to derail the Dorgan amendment!

 

C) Any piece of legislation must be passed by both house of congress before

it can be passed into law, and its NEVER over " til the fat lady sings " ----

which is to say til the President signs it into law. In this case ANYTHING can

be

added into House language that can UNDO anything we might get put into the

Senate language, then the Senate and House language are COJOINED via a markup

hearing at which they generate a CONFERENCE REPORT where the COMBINED LANGUAGE

goes to the President's desk for his signature.
