The machines on the agenda are all made by ES & S. ACTION REQUESTED: If you can attend the hearing in Sacramento on September 19th, please go. If you can’t, please send written comments to VotingSystemComment. Here are some points to emphasize: 1) No electronic system should be certified that cannot produce a paper ballot that can last at least 2 years, to allow for contested elections and re-evaluations down the line. Some systems produce thermal paper rolls or ATM-like slips which fade very quickly and will not be useful for a scenario like that of the 2000 vote in Florida. 2) Ask what the Secretary of State will do if a vendor violates the “rules of use†for their machine. Each machine that gets certified is certified under very specific operating conditions which are laid out in documents that used to be posted on the SoS’s site, but seem to have disappeared of late. Ask what kind of accountability there will be if a vendor does not follow approved procedures. 3) Ask how the Secretary of State plans to ensure that the software that was approved is the software on the machines when we cast our vote. What stops the vendors from slipping in “upgrades†or “bug fixes†at the last minute, which have unverified, possibly corrupted or corruptible code? 4) Ask for a broader audit. State law requires a 1% audit of precincts, selected at random. But the selection is not currently very random †" election officials plan in advance which precincts to audit, based on what is on the ballot. Ask how the Secretary of State will enforce the “random†requirement in state law to ensure that the audit is as useful as possible (1% can tell you a lot in a large county like Los Angeles. It’s basically worthless in the many smaller counties in the state, in terms of being able to detect fraud or error.) 5) Ask what the procedure will be when a voter votes for one choice and sees another come up on the screen, as has happened in several other states. Shouldn’t that be cause for removing the machine instantly? What would the back-up plan be if that problem were widespread? 6) Tell the SoS it’s more important to count your vote ACCURATELY than QUICKLY. 7) Diebold systems should not be certified under ANY circumstances in this state due to the extremely vulnerable hack possible (you don’t need to go into details †" they’ll know. Diebold systems are not the subject of this session, but it bears repeating, and often.). Feel free to come up with your own points/questions/concerns. The Secretary of State’s office is asking for public input. This is one of those times when they are actually listening and compiling responses, so your effort will have maximum impact.
