I'm looking for a general waiver which will primarily protect me from litigation involving 'contamination', real or imagined (isn't there someone in australia right now being sued because there was a worm in their raw herbs?), and secondarily from any risks invlved with taking herbs. Guest guest Posted July 16, 2004 Report Share Posted July 16, 2004 Dear Hugo, This is the text from the one I use - dosages above, this below, although I should say I primarily use powders. ------ If you should experience any of the following, stop taking any Herbal Medication IMMEDIATELY, and call me on: 1. Nausea, Headaches or any Gastrointestinal Upset. 2. If you feel as though you are coming down with a Cold, Virus or Flu. 3. If you are unsure of the dosage, or have any questions. 4. If you think you are Pregnant. 5. If you are having any sort of medical interventions, such as coil/IUD/surgery/altered medication. Herbs are prescribed by a qualified practitioner due to the fact that they have powerful properties. Therefore, it is important to inform your practitioner of any allergies you have, any prescribed medications, medicinal products (even a laxative), or any other herbal or nutritional supplements you are taking when your practitioner prescribes you Chinese Herbs. This is to ensure that there is no adverse interaction between products. Similarly, if you intend to commence any other medical regime, either prescribed, herbal, or nutritional, or consume any other medicinal product while already taking your prescribed , it is vital, and your responsibility, to check first with your practitioner. It becomes your responsibility if you fail to follow the instructions of the practitioner, and/or side effects result due to improper consumption or improper combination of medicines. The usefulness of such waivers will depend on the law of the state / country. I suspect that most waivers re medical risk are worthless if the unhappy litigant has good legal advice. When I began to treat thoroughbred horses with acupuncture, I drafted a waiver in which I listed possible complications, etc. The idea was to inform the owner that there were possible risks (albeit very rare), that the basic responsibility of animal care was his/hers, and have him/her sign the waiver, thereby " covering my back " . Within weeks, a legal friend of mine told me that such waivers would NOT stand up in an Irish court, because the signatory could claim that he/she did not understand the full ramifications of signing such a waiver. I dropped the waiver after that, and take the risk. Touch wood, my trust in the basic decency of people has not been shaken as regards them coming after me if (as occasionally happens) things do not always go as one would wish.
