I guess you are too young to have seen the MArx Brothers or listen to the

auto folks on NPR if you have not heard of this one, eh?

 

 

 

See! I told you it was readily available! He got his law degree from Harvard

Law School in 1959, and is a corporate lawyer who is one of a thousand lawyers

for one of the biggest firms in the country, using that firms resources to

our best advantage. He is also a patient of acupuncture that has seen its

benefit personally before working for us, and he is a great guy, honest and

straightforward with us on the issues that affect us, providing us with

excellent

counsel for our needs, pro bono on a limited basis but always doing more than we

feel comfortable asking for, since he has done so much for us. Mark received

the AAOM lifetime acheivement award at our last conference.

 

What is to deny? Tell me any such large law firm that does not have tentacles

in everything that makes money, including (from below), " the life sciences

field. Our life sciences clients include biogenetics, bioinformatics,

biological, pharmaceutical, nutraceutical, medical device and food and

agricultural

companies, academic medical centers, universities, research centers and

researchers, as well as venture capital and investment banking firms that invest

in

these businesses. " , if you are somehow under the impression that it taints our

attorney. Read HIS information and consider his 45 years of experience in

helping

us build our bylaws and corporate foundation up to snuff, in working with the

FDA to learn our needs and to find out how to best utilize what we have to

get those needs met, an on many other fronts. Are you somehow under the

impression that this guy who has practiced law for 45 years needs to be a mole

in our

organization for this huge firm? Excuse my hearty laugh!

 

While we are on the subject, tell us about Richards law firm, Dan, since you

seem to be so close to him as to suddenly show up with his homework. The firm

that is supposedly doing all this lawsuit stuff he can't tell us about but

that we must accept on promises and his legal understanding of the law and how

it

is adjudicated. And if the suit is won, who makes the money? Now it is his,

or your, turn to make fun of me.

There is a PR release that has been sent several times to 'Acupuncture Today'

weeks ago. They have all the contact information.

 

As to the 'injunction'...that is something that has nothing to do with the

class action lawsuit or anything we have been discussing. It was a personal

issue of an individual that accidently was posted to this group.

And if the suit is won, who makes the money?

The CLASS (meaning ALL the members of the CLASS) equally divides the monetary

awards and I as one of those members will enjoy an equal share...the same as

everyone else.

 

But MORE importantly a CLASS ACTION suit as in this instance is ALL about the

alleged discriminatory reimbursement practices......and therefore the

elimination of those practices. So ALL will benefit upon settlement by being

included. Every licensed acupuncturist benefits these Class Action results. And

even

if one doesn;t wish to access the reimbursement system.....their patients can

by taking the APs 'super bill' and sending it in for reimbursement themselves.

So you see....it helps everyone including all of our patients. And those plans

which do not cover acupuncture now will be hard pressed not to.

Now it is his, or your, turn to make fun of me.

In these open information forums........ practitioners need to know, hear and

see which organizations are FULLY supportive of the advancement and fair &

equal treatment of the AOM profession, it's practitioners and their patients.

Responsible organizations should explain in full...their mission and with the

utmost clarity. If you feel that any one is making fun of you or

AAOM......that's your interpretation as to what is happening.

 

Maybe - as one example - you as Vice President of the AAOM, could explain why

the AAOM does not support the Federal Acupuncture Bill and since the AAOM is

tightly knit (as openly publicized) with the other so-called task force

organizations....why they also do NOT support such a recognition in the United

States of well trained acupuncturists as the statutory providers of acupuncture

for

the Federal government?

 

Correct if this is incorrect.....that the AAOM behind the scenes is actually

AGAINST the Federal Acupuncture Bill.

 

This hive collective - called visioning/task force, claims to INCLUDE all AOM

organizations and stakeholders yet NOMAA (which AAOM openly does not support)

and AOMNC are never included?

 

The profession needs to clearly see that which is obvious. That the old

'sand-box' players don't want any other stakeholders to enter their territory

thereby creating the need for the NEW 'sand-box' so other stakeholders are

represented.

 

This is serious and in no way is poking fun at anyone.
