Guest guest Posted March 31, 2004 Report Share Posted March 31, 2004 Does it matter to our legal battle that the FDA is attempting to ban Ephedra, but they are allowing Pseudoephedrine HCL in cold medication? The fact that this contradiction is being allowed without discussion is amazing to me. Am I wrong in my assumption that Ephedra and Pseudoephedrine HCL are close enough in composition that they should be classified and controlled similarly? Should we intend to have Ephedra categorized with Pseudoephedrine so either we redefine the use of the compound in the marketplace or Pseudoephedrine is taken off the shelves also? No, it does not matter. What you are talking about is not a dietary supplement, as are out patent and prepared medicinals. Brian C. Just so it's clear, Pseudoephedrine HCL is extracted from Ephedra sinica in one of three factories in Western China. The reason that I know this is that in the mid-1990s I used to be a chemist who arranged for America companies to order this product. I had to register every year with federal government's drug enforcement agency as a chemist bringing in USP chemicals from China. The America company would have to place the order and even complete 50% of the final payment by September of the year before delivery. The reason for this is that ma huang harvest would be finished in September, and the line of companies was always longer than the supply of raw material. At any rate, Chris, you are correct that ma huang extracts are still to be found in the local drug store in OTC products. The FDA was founded by America industry to protect and regulate the interests of American industry. It's not a part of the Constitution conceived by Jefferson and the others. You could by a stretch of the imagination say that Merck is a Chinese medicine distribution company because of their Lovestatin product ... derived from a Chinese herb.
