A great many of the laws and agency codes we are subject to are clearly not constitutional but that does not keep the agencies from enforcing them. In general, I would opine that it is OK to mail and sell oleander clippings, seeds and plants as long as they were not labeled for human consumption - after all, nurseries and seed companies do it all the time. Selling the extract becomes a bit trickier, expecially if there is any indication that it were being sold as an herbal supplement. I would not recommend anyone doing it, even if you don't say what it is used for, because you could easily run afoul of the powers that be who target supplements which threaten the profits of the monied interests they really serve. My advice is to either obtain plants or clippings and make your own, giving any excess away to family and friends, or better still for those who want a lab made supplement or medicine, obtain it from the available sources which are all outside the USA (and likely for very good reasons).
