We are also still working on AA issues and trying to bring those herbs back into our pharmacopea. The reality is that there is no written evidence of a OM practitioner causing a problem with AA plants that I know of. Any skirmish short of that is a waste of time and a potential set-back. Those who quote the DC's victory over allopaths do not realize the truth to their failure for not following through. I have spoken to the key litigant in that case and he was quite upset with his own profession becoming sell-outs in the end. In the end analysis there was no win. They had a financial hurt on the allopaths and they let them get away in the hopes of their becoming doctorettes. The undisclosed settlement (most likely only for legal fees) was nothing compared to what they could have extracted. As to DSHEA....there has been a concerted effort to circumvent and dismantle it right from the beginning. Goes to show anyone interested in looking at the reality-picture... what the truth is. Don't know what you are doing or intend to do.....but rying to negotiate or work with the enemy gets us less than nowhere. It actually puts us in bed with them in a co-opted and crippled way. As far as can be seen there has never been any percentages in trying to negotiate or deal with them. They don't want a-deal. They want us to go away or to become totally subservient. I remember not so long ago sitting across the conference table with nothing but lawyers on all sides at a Florida allopathic association when they were ATTACKING Florida APs title of Acupuncture Physician and APs scope of practice (2000-2001). They told us that there wasn't even a snowballs chance in hell that they would let us keep using that title. I closed my eyes and smiled and never said anything. In the end they LOST all of their arrogant attacks and we additionally won the right to use Acupoint Injection therapy. One key difference is that I look beyond seeing the profession alive just for a FEW decades. I see the profession making it's permanent place in world healthcare and much sooner than later. Safe from the attacks of all others by LAW and through the court system if necessary. That's the big-stick. That's the ONLY way. Remember that this is NOT about us as practitioners. It is about the healthcare freedoms of all humans.
