acupuncture legislation in Israel

Dear Shmuel,

 

There is now a Registration Board (CMRB) that has been established in the state of Victoria (where Melbourne is) in the year 2002 that regulates the practice of Chinese medicine in this State. There are three modalities of TCM which are regulated: acupuncture , Chinese herbal medicine and Chinese herb dispensing . The CMRB was established on the basis of a state legistlation: The Registration Bill which was passed by the Victorian Parliament in the yearr 2000 which then became the Registration Act 2000.

 

After the establishment of the CMRB, transistional regulatons were promulgated which set out the grandfathering of over 700 acupuncturists and Chinese herbalists in the State. The staturory regulation of TCM in this state proceeded through the regulation of title and not scope of TCM practice. Hence in this state , only registered TCM practitioners can use titles such as 'acupuncturist' , Chineese medicine practitioner, oriental medicine practitioner, Chinese herbalist, etc. If unregistered practitioners uses any of these titles they can be prosucuted and fined There has been three such cases which has been sucessfully prosecuted recently . These cases have been publicised in the CMRB website (http://www.cmrb.vic.gov.au/) and in it's newletter.

 

The establishment of the CMRB and the introduction of the legislation into the State Parliament was preceeded by a research and survey of the TCM workforce in l995. This culminated into a report : Towards A Safer Choice : The Practice of in Australia published by the University of Wester Sydney in l996.

The Israeli Acupuncture Association is requesting information on the

following subjects, in order to promote acupuncture legislation in

the Israeli parliament:

 

1. Who in your country is permitted to practice acupuncture/herbal

medicine.

 

2. Basic prerequisites for practice, such as: years of study,

academic certification, apprenticeship and other prerequisites.

 

3. Practitioners independence in receiving patients. Does a patient

need to see an M.D. before approaching an acupuncture practitioner,

do the treatments need to be supervised by a licensed M.D., does the

practitioner need to demand that the patient will undergo W.M.

diagnosis, are there any formal forms on behalf of the health

ministry, etc.

 

I shall be much obliged for your inputs on this issue, as the

subject is getting " hot " in Israel, and an " acupuncture " law is

being forwarded to the parliament in the near future. We would like

to know the legal situation on this issue in as many countries as

possible.

Dear Schmuel,

 

To practise acupuncture in Germany (where I live), you need to be either an MD or a "Heilpraktiker" (HP). The MD part must be clear .

 

To become a HP you need an approval from the local medical authorities. The local

medical authorites simply certifies that you are not a threat or danger to the public health. The aspirant needs to go through a written and a practical examination, where his/her medical knowledge and abilities are put to test. Once you pass this examinations, which, I think, the large majority doesn`t (I am not sure about the statistics), you are allowed to practise as a HP.

The HP has the liberty to practise the therapy form of his choice.(like acupuncture, homeopathy etc)

 

So, in order to practice acupuncture/herbal medicine, the state wants you

to be either an MD or a HP. No basic prerequisites like years of study etc. The HP is

entitled work independantly, doesn`t need to be supervised by a licensed MD, and he need not

demand the patient to undergo WM diagnosis.

P.S: I have talked with an MD and a HP on this theme. Both have confirmed my information.

Hello Shmuel,

Here's a passage from a paper i'm in the process of collating -

basically an overview of the contemporary diverse practice of chinese

inspired practices in the UK, and the future for such practices.

 

....the concept of Integrative medicine is the integration of CAM and

orthodox western medicine into a working partnership in conventional

health care, enabling every person to have access to the full range

and combination of health care services that contribute to reduced

sickness and increased health related quality of life. The Prince of

Wales's foundation for integrated health concluded that CAM would

thrive in mainstream medicine healthcare where it satisfies an unmet

need, it will need however to address four key issues: attitudes of

both CAM and conventional providers, evidence of effectiveness and

safety, ensuring adequate training, and funding. Working groups and

committees have since been set up to enquire into CAM and is

currently being carried out by the House of Lords Select Committee on

Science and Technology. A five-year aim of the Prince of Wales

foundation for integral health is to help in the process of statutory

regulation of CAM to address the four previous issues. Reports of

recommendation have recently been produced and submitted to the House

of Lords' committee by two separate pioneering groups. The Herbal

Medicine Regulatory Working Group (HMRWG) looking at the implications

of statutory self-regulation for Traditional ,

Ayurveda and the western herbal tradition. The Acupuncture Regulatory

Working Group (ARWG) looking at the options for both traditional and

western medical acupuncture. The two reports have now been published

by the foundation, on behalf of the working groups. The Department of

Health will use these to help it produce formal proposals for

consultation in the New Year...
