Since the Bush administrationtook office the FDA has become the industry's partnerin crime. The most notorious protection scheme put in place bythe FDA and Big Pharma is the preemption policy thatbans private lawsuits against drug companies in statecourts once a drug and its label have been approved bythe FDA. On January 18, 2006, the FDA issued new rules for thelabeling of prescription drugs, and in the preamble tothe rules on page 43, the FDA says, State law actions“threaten FDA’s statutorily prescribedrole as the expert Federal agency responsible forevaluating and regulating drugs,” requiring laypersons to second-guess its expert assessments of adrug’s risks and benefits.
