HIPPA, Mother of Incarcerated Son Denied Health Information Please read this below?

Dear Mother of Incarcerated 21 Year Old Son,

1. Get your son to sign an Authorization to Release Medical Information to

release information to you. HIPPA is supposed to protect patient's right to

privacy;not a risk management tool to prevent patient's family from having

information about him.

2. Texas Board of Medical Examiners-file a complaint that your son wants you to

have his medical records. I haven't read your entire e-mail. All I had to see

was that they were using HIPPA as an excuse not to tell a Mother about what they

are doing to her son.Whatever problems you think your son is having with the

doctors, get a fax machine and fax it directly to the Texas Board of Medical

Examiners the day your son tells you.

I was helping a full time brain injured man in the hospial this weekend with

these same issues secreting health care information from me as his advocate.

After his doctors refused to communciate with me from Friday-Sunday I faxed the

Alabama Board of Medical Examiners a 9 page single line 10pt. complaint. They

were apparently up until Midnight trying to figure out what to do with him as

that is when his doctor came into his room Monday night. Now he's getting the

right attitude exhibited to him and a referral to the brain surgeon that saved

his life 4 years ago instead of laying up in the hospital being drugged up with

drugs that were making him worse charged to Medicare/Medicaid.

3. I'm not an attorney but your son might want to sign Medical Power of Attorney

to you.

4.Find out when the Board of Corrections meets. Gov.'s regulatory board. Go one

time just to case the place out and get comfortable. They may have a time you

can speak at the end of the meeting. Start going every month AFter the meeting,

hand out a written complaint to every Board member about whatever they are doing

to your son and not letting you have any health information on him.

5. Same for Board of Pardon and Parole.

Your son could die from medical care and you seem to have no way of knowing what

they are doing to him. Then without medical records you would have no evidence.

If they won't give you the health information on him when he's alive, how do you

think you would get it if he were dead?

6. HIPPA mandates the provision of medical records within 30 days. Find out who

the HIPPA compliance officer is. If anyone tells you that HIPPA is the excuse

they are giving you to not tell you about your son, document exactily what they

said with the time and the date and send them a certified return reciept letter

asking them to send you a copy of the exact HIPPA statute to which they were

referring.

7. The Department of Corrections, Board of Pardon & Parole and Texas Board of

Medical Examiners are all executive (Governor) departments. It's best if you get

a fax so you can fax quickly and without having to pay for postage and copies,

etc.Copy all your correspondences to the Governor, Lt. Governor, Secretary of

State, Speaker of the House and get your State Senator and State Representative

to tell you which Chairs of which committees have to do with these issues with

your son.

8.Contact your CONGRESSIONAL Senators (2) and Representative (1).

File a complaint that HIPPA is being used as an excuse not to tell you about

your son.

Get them to help you learn about HIPPA.

9. Get a notebook and make a separate page for each public official you are

communicating with. Everytime you talk, write, whatever-GET THE NAME of the

person you are talking to and document the time, date and what was done.

If they hurt your son and you have to have a lawsuit, you will need this as

evidence that they were trying to cover up the iatrogenic health care.

10. Instruct your son to keep a list of all the drugs he is taking with correct

spelling and dosage and inform you every night. I can give you the number of a

company where you can economically get him a toll free voice mail and 800 to

call you where he can either leave you a message at no cost from a pay phone

where you can check it at no cost or he can call you on the 800 number and it

only costs you regular long distance at less than $.05 per minute. I know they

reallytryy to stick it to you on the long distance charges in prison.

You may send me SHORT e-mails for further brainstorming ideas after you have

implemented the above unless it's for the phone info.

The next time you talk to your son, remind him and yourself that it was your own

inappropriate behavior that created these conditions and strive in the future to

refrain from creating this suffering for yourselves in your family.

I'm copying this to Jim Moore who is in Texas (mofunnow). He can put you on some

that can teach you about why these prisoners may be having seizures

because of the psychiatric drugs they are being prescribed. GET THE NAMES OF THE

DRUGS from him that they are prescribing. Make sure he reports to you EVERY DAY

or writes it down and gives it to you when you talk on the phone or mails it to

you so you have the information directly from him.

Then you get on the internet and research the side effects.

He should ask the doctor for the PHYSICIAN'S DESK REFERENCE pages on EVERY DRUG

he is being precscribed. Once he gets TWO copies, one to keep and read and one

to circle the side effects he is experiencing (and then another copy of the

first page once he turns in the 2nd page to the nurse and asks for a copy of

that and mails the evidence that he's notified them of the side effects-they may

try to remove the evidence from his cell if he doesn't get it out to you)

then he needs another copy to hand in again. He may need to tell you the names

of the drugs, you mail him the information with several copies. He writes down

the date and circles the symptoms he is experiences on 2 pages-one to doctor,

one to you and calling you that day or writing down in a tablet he keeps on his

person at all times that can't be taken from him, the days he send you letters

to make sure you are getting all his correspondence.

I hope you can use this information to assist you in helping your son help

himself.

Who is his attorney?

Fax him all your correspondences.

Set your fax so you get a confirmation.

Fax the confirmation after you've sent to original fax so that he sees you are

keeping a documentation of all the correspondences you are copying to him.

As a matter of fact, get the fax number of the judge that sentenced him and copy

his court clerk all your correspondences also and the DA that prosceuted him.

Get a fax machine.

Chad was moved in Dallas County Jail Infirmary yesterday!

I cried out and thanked my good Lord near all day as you can only imagine how my

state of mind has been since losing my 21 year old son and then having to worry

so much because they refused to medically treat Chad in jail. I am pretty much

of a worry wart anyway for those that I love in life but I had such fear of

losing another son.

Of course the nurse told me that she could not tell me anything because of the

HIPPA laws but she then told me that Chad was on his prescriptions now and that

she had started the scripts today.

I had heard from another mother of a boy in the same jail tank that Chad is in

that Chad had a seizure and so I stayed awake all night last night praying. Then

when I talked with the nurse there I was so relieved.

I asked her why they had waited until Chad had been in jail for two months

without giving him his medications and she said she couldn't tell me all that.

I have heard that if a person signs papers giving the medical permission to tell

their moms, dads, or whoever anything medical about that person that they have

to give this info. Chad signed a paper giving them permission to tell me

everything but they still don't. I shouldn't grip about this since they finally

gave him his meds but it seems they could do this so I could at least know the

medical status of Chad.

See, I do not get to even go visit him. This is the first time in all my 50

years that I have had a warrant but I just could not pay a no vehicle insurance

ticket I got that was $480.00 so I can't go see him or they will arrest me for

this warrant. I can't receive collect calls because the phone company would

not give me home service unless I agreed to this because I am so low income.

But I could call the medical facility and see if he was ok but they just refuse

me this.

Oh well... I am truly blessed that God put ya'll in my life and I just wanted

ya'll to know of this miracle you caused to happen for us and I am not kidding,

it truly was a miracle!

Glenn, you told me that you faxed Attorney Bill Cox III about Chad and him

possibly taking Chad's case. Just wondering if you may have possibly heard

anything back from him about this? And thank you for doing this and I am sure

God will bless you more than any money could ever amount to.

After 13 years of advocating for sick people in jail and the free world, I have

never seen the medical facilities in jails ever really help the sick. They

always lie to families and is advocates but they never really have helped any of

them and most of the time people who are not even violent inmates die from

medical negliance inside and as we all know the only reason 99% of these people

stay in jail is because of the discrimination on the poor for not having money

to bond out with and can't afford anything but a court appointed attorney that

have been proven to be sleeping attorneys in Texas! My son is Chad Ray Bennett

D.O.B. 4-6-74 and he is in jail in Dallas County Texas because his new wife that

he has only known a few months had been fraudulently calling in her own pain

medications and for over 5 years before my son knew her and she got caught and

he has been in jail two months now because he was with her at the pharmacies to

pick her scripts up. None of us knew these was fraudulent and many of us took

her to the pharmacy to pick her scripts up because she did not have a vehicle.

She worked for a doctor 5 years ago and was licensed tech and this was her job

for that doc so she continued doing this all these years after she quit him many

years ago. She is in jail also but my son does not deserve this. I took them to

the pharmacies near every time and I was there with them also. We had no idea of

this being done wrongly and my son did not need her scripts either because my

son has brain and testicle masses, Lyme Disease, etc. My son has a lifetime of

prescribed pain medications from Baylor Hospital in Dallas Texas and the courts

and all know this as I sent them copies of my sons medical records and

prescription copies.

It is no longer innocent until proven guilty in America unless you have money

and this is the worst kind of discrimination on the poor. If anyone feels they

can contribute to writing the Judge of my sons case and the medical doctors at

UTMB ( this company contracts Dallas County Jail medical) please do so and I

thank you greatly. My 21 year old son died last year and this has been a

nightmare and I so fear for my son and I have a very ill 28 year old daughter.

We all have Lyme Disease.
