Dear M,

Unless you act now, next week Congress will vote to limit your access to

state courts and make it harder for you to hold corporations and others

accountable for wrongdoing and unfair or deceptive practices.

The U.S. Senate will be voting on S. 2062, the so-called Class Action

Fairness Act, which would preempt existing state law and strip the state

courts of their jurisdiction over most class action cases, and over many

mass tort cases as well.

Contact your Senators’ now and urge them to oppose this anti-consumer

Even if you have never been involved in a class action case, it is important

for your voice to be heard.

This bill is being touted as a first step in a broader plan to limit your

right to hold wrongdoers accountable in all tort cases and give more rights

to wealthy and powerful corporations.

Class action cases are one of the most effective ways of ensuring that

powerful corporations are held accountable when they do harm, by allowing

individuals lacking the resources to file cases on their own to band

together and bring suit against powerful interests.

Class action cases serve not only to provide justice for those who have been

wronged, but also to deter future wrongdoing.

This is a draconian bill. It is not, as advertised, a fair compromise. It

would allow defendants – mainly large corporations – to remove to the

already over-burdened federal courts most class action cases filed in state

court. It would introduce massive confusion to the process of bringing

class action cases to court, allowing those with greater resources to

effectively manipulate the system to their advantage.

This is the last opportunity to stop this bill – the House has already

passed it – and the Senate will begin debate on it on Tuesday, July 6,

immediately following the ten day Independence Day recess. There will be

no filibuster against proceeding to the bill.

Please forward this message to your colleagues and friends and alert them to

this attempt to limit their rights to hold wrongdoers accountable, and tell

them how to contact their United States Senators today.

Interesting,

I have been advocating and pushing for years just this sort of action

against corps and fed agencies alike. All of my efforts have been met with

cowardly silence. And now you expect the ostrich class to pull their heads

out of their respective holes and do something to stop this bill? Wherever

will they find their long absent spines? I would point out that they have

opperated for too long with fear and handwringing aquiesence as their guide

through life to suddenly make a united stand. Nevermind that making a stand

requires that an individual have a spine in the first place. What chaffs the

most is that through cowardly innaction, the ostrich class dooms my family

to the same fates.

One other interesting note; Public broadcasting has just finished its series

entitled Rebels and Redcoats. Even a cursory examination of the Declaration

of Independance reveals that we face today most of the very same grievances

we sought to throw off through redress. When redress becomes impossible what

then? Well, with the exsisting ostrich to spine ratio that we face

today,..... GULAG USA! Another thing that chaffs is that those people gave

everything for freedom and liberty only to have it taken back by the same

monster due to the lack of vigilence by the recipients of their sacrifice.

 

Sorry folks, I grow so weary of the wussy little dance and needed to vent. I

will now go back to my quiet little corner and reassume my proper role of

the lurker that nobody responds to.
