UPDATE ON THE ALAN YURKO STORY By Francine Yurko When my husband Alan was convicted of our son's death and sentenced to life in prison without parole, we were still in shock over our baby's death in 1997 and the horrific subsequent events. We had no money and hopes were virtually nil. However, we weren't going to give up. We began networking and researching and knocking on every conceivable door. Today, the Yurko Project has evolved to include hundreds of doctors and experts, as well as thousands of supporters worldwide. At least half our time now is dedicated to helping the constant onrush of families in similar straits. The rest of our time is devoted to overturning Alan's conviction and this has begun to heat up. The appeal, after 18 months in the courts, is nearing a preliminary decision by the judge and has been recently amended to detail the toxicological findings of Dr. Mohammed Al-Bayati. We expect a ruling in 2004 which hopefully would allow us to argue the merits at an open hearing. We have filed formal complaints against certain doctors involved in the State's prosecution. Also, the Florida Department of Health is concluding its investigations. The media, which initially painted us as monsters are now providing more balance in their coverage. We believe this is due to the overwhelming preponderance of evidence we've amassed to prove Alan's innocence, as well as the armada of respected professionals on our side. Meanwhile, we continue to face a very heavy financial burden. The State and their doctors have virtually unlimited funds to present their case. This is a huge factor. It has been said that " America has the best justice money can buy, " and sadly, we've learned this from personal experience. Most families cannot afford to mount a proper defense which can cost up to four hundred thousand dollars. Faced with this extraordinary barrier, the accused in shaken baby syndrome cases are often forced to rely on Public Defenders. Were it not for many of our experts waiving and/or discounting their fees in the interests of justice, we would never have been able to come this far. We are now afraid that we will not be able to raise the tens of thousands of dollars needed to pay for the medical and legal expenses which hover at about $200 per hour. Thus, our focus has shifted to fundraising. We were not medicolegal experts, fundraising professionals or grassroots activists when our son died. We've learned as we went along. Our adversaries are, and have been, learned individuals with financial backup. I have often thought that for every penny the State spends on their case, a matching amount should be allotted to indigent defendants. If so, we would have had the truth at Alan's trial, and also I doubt that the State would prosecute many of these types of cases. It all boils down to money.
