Hold onto your hats, it looks like the Frist bill is dead. Please take this

with a grain of salt but it doesn't look like there's any way the Frist

Version of the VICA bill (including Eli Lilly provisions and a strict

deadline on the statute of limitations for older children) could move

forward again in Congress.

 

From a friend on the hill:

 

The House is hopelessly deadlocked and not willing to consider the Senate

version (with many concessions) as a starting point for negotiations. Frist

also has plenty on his plate right now, so his personal interest has

subsided. I can't believe that a bunch of rag-tag parents managed to block

PHARMA.

 

Some comments from an anonymous lawyer who sent a message to us recently

about the lawsuits moving through the VICA system:

 

The Special Master (VICA Cases) has been ruling against them (pharma cos.)

along the way. Also, this summer, the appellate court expanded the statute

of limitations for the autism cases saying they were unique and the current

statute too restrictive. Court said that the clock should start the first

time a doctor mentions something, not upon the first impression. Civil

courts are the same way. Things looked to be going against us, but recently

more of the district federal courts are ruling in our favor. The 5th

circuit just refused to review the Louisiana case which held everyone in,

said that the thimerosal manufacturers don't have protection in VICA and

said that the cases belong in state court.

 

So fellow justice fighters, the bottom line is, we will continue to watch

this closely with our contacts we have made on Capitol Hill but for now,

Frist has been knocked out by " a bunch of rag-tag parents. "

 

Thank you, thank you, thank you for all of your faxes, letters, phone calls

and if you managed to get away from your complicated and busy lives to

attend the rallies on Capitol Hill. Your letters, faxes, phone calls and

visits made a huge difference. We showed them that we had honesty, integrity

and principle on our side. We showed them, --Either you are FOR mercury and

the mass poisoning of thousands of children or you are NOT. - For us, there

was no gray area. We believed there should not be some arbitrary line in the

sand. Those in front of the line get justice. Those behind it do not. We all

fought for justice for ALL - an older child getting justice was just as

important as a younger child getting justice. We also fought to make sure

that those accountable, like Eli Lilly, were forced to have their day in

court. Just like any other company in their situation.

 

The war is not over. We still have a long way to go for our children to get

justice (ultimately a CURE) - but for now we have won a major battle. We all

deserve a pat on the back today. We all made a difference. Congratulations

to all of you! Thank you again.
