Ladies & Gentlemen:

The vaccine cases are getting stronger and stronger, but we are spending

every waking moment now trying to educate people regarding Proposition 12

here in Texas--the so called " Medical Malpractice Reform bill " .

On September 13, 2003, Texas will hold a special election in which the

voters are being asked to consider amending the Texas constitution to allow

the legislature to place caps on damages in every civil case decided in

Texas, as well as other sweeping changes. This Spring, the Texas

Legislature passed a resolution that will shift the power to decide damages

in ALL civil cases from judges and juries to politicians instead. That

means the Legislature--elected politicians--would be given the authority to

decide damages instead of courts, judges and juries. But Texas law says

they can't change the Constitution without your permission, and on September

13, 2003, you'll have an opportunity to stop it by voting NO in a special

election on this resolution, which is called Proposition 12.

The story doesn't end with damage caps however. If Prop. 12 is passed,

the vaccine litigation in Texas (other states will continue) may come to a

complete stop due to the " FDA defense " that is snuck in the bill that says

" If the FDA approved a product or device (such as vaccines) then the

manufacturer is immune from liability. Here is the big problem with that,

as many of you already know from watching the Congressional vaccine/autism

hearings before the U.S. House Committee on Government Reform, the FDA

relies on the manufacturers for the so-called safety studies, they don't do

any independent investigation!!!! This is just wrong.

Early voting has already begun.
