Guest guest
arnoldgore Sun, 17 Aug 2003 10:41:29 EDT NYS Refuses to Re-Issue Dr.Daniels Medical License-Action needed Dr.Jennifer Daniels,MD of Syracuse,NY, the pioneering holoistic doctor who had her license suspended two years ago for refusing to consent to an unrestricted search of her medical records won her case in the Appellate Division of NYS Supreme Court. The Office of Professional Medical Conduct (OPMC) was directed to re-issiue the license. In other words it had been illegally suspended for 2 years! The OPMC has refused to comply while they are appealing to the NYS Court of Appeals. In Dr.Daniels case, there was no patient harm done. The case arose after Dr.Daniels successfully treated a patient with diabetes using just diet and exercise. She successfully reduced the patients' blood sugar from 465 to 138. The patient went off the diet and went to a hospital emergency room. The doctor in the emergency room could not understand how a patient with diabetes was not on insulin drug therapy and reported the case to OPMC, which was not satisfied or did not want to hear Dr.Daniels explanation. In August 2001, the Secretary of Health & Human Services held a highly publicized press conference to discuss the recenly publishec findings that just diet and exercise was MORE effective in controlling diabetes than drug therapy. He said, we have to get this information out to all the practicing physicians. He forgot to direct this message to the medical boards which have the power to inhibit doctors from using the best therapy, especially if it is an alternative that avoids prescription drugs. Dr.Daniels was the Green Party Candidate for Lieutenant Governor in NY State in 2002 and the Green Party and Libertarian Party candidate for Mayor of Syracuse in 2001. The willful refusal to follow an appellate court order is highly suspect in this case. The message being sent to ALL alternative medical doctors in New York State is that no matter how careful you are and even if the courts rule in your favor the state will not comply and drive you to bankruptcy and ruin. Call Governor Pataki and ask that he make sure that OPMC a part of the Health Department follows the orders of the court and restore Dr.Daniels license. Pataki's New York City office is 212-681-4580. His Albany office 518-474-8390. The Chairman of the Assembly Health Committee is Assemblyman Richard Gottfried. His NYC office tel.# is 212-807-7900. Call him and ask that he exercise the oversight function to see that OPMC follows the court order to restore Dr.Daniels' license. If you are a prospective patient who wants to use Dr.Daniels, call your local Assemblymember. The name and phone number can be obtained from the assembly website: www.assembly.state.ny.us
