It is solely up to the legislature. arnold Texas dentist John Brown posted the following to the the dental public health list: Here is the link to the Espronceda vs City of San Antonio appeal to the Texas District Court's refusal of the initial suit opposing fluoridation .The appeal was denied with prejudice on 5/21/03 http://www.4thcoa.courts.state.tx.us/opinions/HTMLOpinion.asp?OpinionID=16114 It reads very well, reaffirms the police powers in Public Health, says the burden is very much on the claimants, quotes much legal precedent, says no one is compelled to drink the water and may choose other water sources, and concludes that the the overwhelming evidence supports fluoridation. It make good reading , especially for students of public health.
