Senator Bill Frist (R-TN) will introduce the VICA (Vaccine Injury

Compensation Act) bill for the fifth time this week which will once again

seek to protect drug companies from Thimerosal-related litigation while

eliminating legal recourse for families of vaccine-injured, mercury-toxic

children.

The new legislation, sponsored by Senator Judd Gregg, comes on the

heels of a just-published report in the Journal of the American Association

of Physicians and Surgeons. The research, conducted by Dr. Mark Geier and

David Geier, analyzed mercury doses children received from Thimerosal in

childhood vaccines in comparison to Federal Safety Guidelines. The doctors

concluded that mercury from Thimerosal did exceed Federal Safety Guidelines

and that the study provides " strong epidemiological evidence " for a link

between increasing mercury from Thimerosal-containing childhood vaccines and

neurodevelopmental disorders such as autism that has reached epidemic

proportions. The authors stated, " A causal relationship between

Thimerosal-containing childhood vaccines and neurodevelopmental disorders

appears to be confirmed. "

Here are a few questions posed that may help you understand this

legislation if this is the first you are hearing of it. These questions will

also help once you get to the ACTION ALERT letter below.

Questions: Why the Tuesday deadline?

Sending your letters on Monday, March 24th (today!), and at the latest

Tuesday, is very important because Frist is expected to take the VICA

legislation, again!, to the HELP (Health, Education, Labor and Pensions)

Committee for mark up then. Mark up means that all Senators on the committee

have a chance to make amendments before it is sent to the Senate Floor for

votes. It has been told to us that Frist has enough votes for the plan as

is. Therefore, parents MUST act now to preserve ANY rights - especially

those with children born before 1998.

Why is this my last chance?

It is your last chance to tell the Senate the needs of your

vaccine-injured child as it pertains to VICA. If the HELP Committee votes

this legislation in, it may be the last chance the pre 1998 cases have to

put any claims for injury into the Vaccine Program. These parents and

children have NOTHING now. Perhaps we can get something with the

legislation, if amended. After this bill passes the Senate, it goes to the

House. There we hope to make a difference. Then it will most certainly be

voted into law - whether you've put in input or not.

What is the Senate HELP committee?

Health, Education, Labor and Pensions. Judd Gregg is the Chairman and

actually his name appears on the legislation but everyone knows it is fellow

committee member Sen. Frist who has penned the legislation.

What does being six have to do with anything?

Sen. Frist has allowed the statute of limitations to be extended to

six years. This means that children injured 1998 and after have a chance to

enter the VICA program. This is very important because if you cannot enter

the program (you are out of the three year statute as it is) you cannot go

on to civil lawsuits. Therefore, as it is right now, everyone out of the

three year statutes has NO due process. They are barred from the program and

civil court. Frist is extended that to six years but what about the

THOUSANDS of children that were injured pre 1998? We must all stand together

to preserve their rights. Lyn Redwood of SAFEMINDS expects that many of the

pre 1998 children stood to have more exposure to Thimerosal because it was

before many shots were combined, the parents and children have suffered the

longest, and the children have not had the opportunity to be helped by early

intervention as much as the later children. This means that the ones who

stand to suffer the most get the least help from the government. Plus, it is

wrong to shut ANY child out.

What is VICA?

The Vaccine Injury Compensation Act. It was penned in 1988 with the

help of Barbara Loe Fisher and Kathi Williams of the National Vaccine

Information Center. Barbara and Kathi are also working to preserve as many

rights as possible with the HELP committee now. The wonderful thing about

Barbara and Kathi is they are in constant contact with the leaders of parent

groups making sure everyone is informed.

I'm not sure if my child is vaccine injured or not, should I write

letters too, why?

Especially if you are not sure, you need to write. Not only are you

helping other autistic children and their parents for the greater good, but

part of the legislation amendments is for a look back (anyone can file no

matter what age) should a link be proven between any injury suffered (i.e.

measles colitis) and a vaccine. Your child may fall into that category or

another if not the Thimerosal category. No shorter or no longer than three

paragraphs? Of course, parents can write what they want and as long as they

want. However, we have recommended no longer than three paragraphs because

we suspect Senators and House members will get many letters and simply will

not read them if a parent sends a long, drawn out letter.

How are children being left behind?

The proposed six year statute only goes to 1998. Everyone else, 1997

and back, will be left out. AND if they cannot access the program they

cannot file in civil court either. These children are barred forever from

due process and equal protection under the law.

WE ARE ASKING THAT ALL PARENTS GET INVOLVED FOR YOUR CHILD'S FUTURE. A

LETTER IS BELOW THAT IS CIRCULATING ON MOST AUTISM BOARDS ALERTING PARENTS

OF THIS LEGISLATION.

 

 

URGENT! NO PARENT SHOULD BE LEFT BEHIND EITHER. PLEASE FORWARD THIS

REQUEST TO EVERY PARENT IN THE ASD COMMUNITY.

letters while being a voice for your child. This next letter might just be

the last one you write. It's now or never.

Several organizations in our community are currently lobbying with the

Senate HELP committee members on your behalf. Lawmakers also need to know

what YOU WANT for your child. If you want to make absolutely sure lawmakers

know what safeguards and protections you want these organizations to be

pursuing for your child, YOU NEED TO LET YOUR VOICE BE HEARD. It's critical

that you write to every Senator below, as well as each committee member FROM

YOUR STATE. THIS IS OUR LAST CHANCE TO HAVE A SAY IN OUR CHILDREN'S FUTURE.

Please, even if you've done it before, do it again. The issue is on the

front burner now---these politicians are paying attention. YOUR LETTERS

Monday, then Tuesday. After that, we are afraid it will be too late. Please

To The Autism Spectrum Disorder - Vaccine Injured Community

Last week at the rally [in DC], Chairman Dan Burton asked that

everyone in the autism community have their voice heard as the Senate and

House take up vaccine injury legislation. I am forwarding you the list of

members of these two committees. Time is of the essence, so I suggest

faxing with a follow up telephone call to the health staffer on the member's

staff.

As you know, last week the Senate Health Labor Education and Pensions

Committee postponed marking up the Vaccine Injury Compesnation Program

(VICP) legislation. However, they have acknowledged that it is scheduled

for mark up this Wednesday. When a bill is voted " out of Committee " it is

then cleared to go to the Senate floor for possible passage. It is

important for the members of the Senate committee to hear from all the

families who will be affected by the decisions they make on legislation

before Wednesday. It is also important that the members of the House

Committee who control the progress of legislation that has been introduced

on the House side as well.

As yet, the House Committee has taken no action to move House VICP

legislation. Your letters should tell your personal story and should

clarify as applicable that (1) you have a vaccine-injured child, (2) you do

(or do not) have access to the fund because of the statute of limitations as

it stands or as it is proposed, (3) concerns if you have them about other

provisions, such as the genetic provisions that many are concerned would be

used to exclude compensation, and (4) some estaimate about the financial and

emtional/social toll the vaccine injury has taken and will take in the

future on your family. If you are a constituent of the member you are

contacting, make sure they know that.

We'll keep you posted as things progress. And to paraphrase the guys

on Fox news - stay informed, stay vigilant, stay tuned...together we can

improve the vaccine injury compensation program.
