Update on Model Emergency Health Powers Act

DR. MERCOLA COMMENT:

 

Since this is a bit of an unusual type of article I thought I would

put my

comment first. It appears some very dangerous legislation is being

prepared to

be implemented in the US.

If this legislation passes, in brief:

 

1 - You will have a mandatory vaccination or you will be charged with

a crime

 

 

2 - You will get a mandatory medical exam, or you will be charged

with a crime

 

 

3 - Doctors will give the exam or you will be charged with a crime

 

4 - Your property can be seized if there is 'REASONABLE CAUSE TO

BELIEVE " that

it may pose a public health hazard... it can be burned or destroyed

and you

will NOT have recourse or compensation.

Threatens Civil Liberties. Unelected officials can force vaccinations,

quarantines, rationing & property seizures.

 

The Emergency Health Powers Act (EHPA) is a draft prepared for the

Center of

Disease Control (CDC) by the " Center for Law and the Public's Health "

at John

Hopkins and Georgetown University.

 

The CDC is urging all states to adopt an EDPA which gives the

governors of the

states broad, unilateral emergency powers. The original draft came

out on

October 3, 2001 and because of public outcry against it, a revised

draft was

issued December 21.

 

In Illinois there has been two legislative bills introduced to

establish the

Illinois Emergency Health Powers Act. One is SB 1529 sponsored by

Sen. Lisa

Madigan (Dem.) Currently SB 1529 is stalled in the Senate Rules

Committee and

is not an immediate threat.

 

The second bill is HB 3809 and is sponsored by Rep. Sara Feigenholtz

(Dem.),

Rep. Robert Bugielski (Dem), Rep. Daniel Burke (Dem) and Rep. Louis

Lang

(Dem). This bill is in the House Committee on State Government and

Administration and can be called for a vote at any time.

 

It is critical that you contact your Illinois representative and

senator and

have them vote " No " to establishing the Illinois Emergency Health

Powers Act.

Below are provisions included in both bills:

 

Creates the Illinois Emergency Health Powers Act

Authorizes $50,000,000, for the total amount of all expenses,

approved by the

Governor, for any fiscal year

Allows the Governor, by Executive Order, to declare a public health

emergency

if specific conditions are met

Gives the Governor broad, unilateral emergency powers, including

financial

powers

Designates the Department of Public Health as the public health

authority and

the Department of State Police as the public safety authority

Provides for detecting, reporting, and tracking public health

emergencies, and

for dissemination of information

Authorizes special powers over persons including medical exams, and

tests,

vaccinations, isolation and quarantine, access to patients health

records and

for property take powers of eminent domain

Provides for penalties, trial courts for appeal of quarantine, for

refusal of

vaccinations

Authorizes special powers for licensing and appointing health

personnel

Provides for immunity from liability

Provides that the Act controls over conflicting laws and rules

Pre-empts home rule powers

Exempts from the reimbursement requirements of the State Mandate Act

Amends the code of Civil Procedure to authorize quick-take powers of

eminent

domain

Effective immediately upon passage of law
