This is a total violation on civil rights, and is something that was done in Nazi Germany and other dictatorial police state governments... if you go to the emergency room the staff there (docs) will be able to lock you up, and claim immunity (protection) for violating your rights... this is a crime.

Hello all!

 

I need your help on something --keeping in mind that any entry into psychiatry creates folks who can receive the treatment of next resort, ECT.

 

House Bill 405, sponsored by John Davis, is a huge backward steps re human civil rights. It authorizes emergency room docs to detain people for 24 hours, solely based on their opinion or suspicion of "mental illness." NO police, no mental health deputies, no nothing. Then they can arrrange transport to a lockup, and they are granted immunity from lawsuit! Somehow (one powerful lobby) this awful thing got through the House and we have just a couple of days to kill it in the Senate.

 

As Lee puts it, "Obviously, putting the frailties of psychiatric diagnosis in the hands of ER docs who have even less training than psychiatrists is at least as dangerous as leaving it in the hands of pyschiatrists themselves. If this bill moves, it will move fast. it is going to need the same sort of urgency as the mental health screening bill did last session."

Your Civil Liberties are at Risk

 

House Bill 405 is moving rapidly through the Texas legislature. This bill is the biggest threat to civil liberties that we’ve seen in many years. It allows an emergency room physician to detain you for up to 24 hours without a warrant, without a court order, and without any involvement from law enforcement.

 

Imagine showing up at the hospital for urgent care and then being told that you cannot leave; that you are being held under mental health detention.

 

According to Sgt. Kitty Hicks of the Travis County Sheriff’s office, mental health deputies are often called to emergency rooms, but she wrote that according to her statistics, out of all the calls they get from emergency rooms, maybe in only 2 to 3% of them would the deputies take and commit the person even though the medical doctor disagrees.

 

Think about that figure long and hard. If the Sheriff’s office is taking the person into custody in only 2 to 3% of cases, what would happen if we gave police powers to these same ER physicians?

 

In essence, this is what HB405 does. It gives police powers to doctors. This means that doctors could detain you for up to 24 hours before your due process protections even started.

 

Consider this from Alexander Hamilton:

 

The creation of crimes after the commission of the fact, or in other words, the subjecting of men to punishment for things which, when they were done, were breaches of no law, and the practice of arbitrary imprisonments have been in all ages the favourite and most formidable instruments of tyranny. The observations of the judicious Blackstone in reference to the latter, are well worthy of recital. "To bereave a man of life (says he) or by violence to confiscate his estate, without accusation or trial, would be so gross and notorious an act of despotism, as must at once convey the alarm of tyranny throughout the whole nation; but confinement of the person by secretly hurrying him to goal, where his sufferings are unknown or forgotten, is a less public, a less striking, and therefore a more dangerous engine of arbitrary government."

 

HB405 hits directly at the protections afforded us by the framers of our Constitution. Confining someone in an emergency room or the back ward of some psychiatric hospital is a huge threat to everything our nation stands for.

Tell them to protect the Constitution and say no to HB405!
