Hi Jorge, Perfect solution. By the way, as in this instance the very same language was used in the act to admit Rhode Island, on June 14, 1790. Journal of the Senate of the United States of America, 1789-1873SATURDAY, FEBRUARY 19, 1803. "Mr. President: The President of the United States did, this day, approve and sign "An act to provide for the due execution of the laws of the United States within the state of Ohio." Here's what 19th century scholar, Alexander Johnson, wrote in Lalor's Cyclopedia, 140 years ago: The act of Feb. 19, 1803 . . . declared that Ohio, by the formation of its constitution in pursuance of the act of April 30, 1802, "has

become one of the United States of America," and provided for the extension of federal laws to the new state. . . . if the precedents in the case of the admitting acts of all other new states are to govern this case, Ohio as a state dates from the act of Feb. 19, 1803. [ His hestitation, of course, touches on the matter of the later alternative date of March 3rd.] Jorge Angelino <jorge.angelino wrote: Dear John, Thank you for bringing this to my attention. While Congress had approved Ohio's boundaries and constitution, the State retained no official record of notification to the State of Ohio authorities. Many "Buckeyes" feared that technically, therefore, Ohio was not a duly admitted State. Ohio congressman George Bender wanted to remedy this embarrassment and so introduced a bill in Congress to "finalize" the admittance of Ohio to the Union, retroactive to the relevant Act in 1803. Dear John,

As you know, RI was the last of the 13

original colonies to ratify the Constitution. They did it on Saturday, May 29th, 1790.

Regarding their TOB, I received this

answer to my query on RI:

Mr. Angelino,

The RI vote occurred at 5:20 p.m., Saturday, May 29th, 1790.

The

journal of the convention relating to

same reads as follows: " Saturday, May 29th, 1790 --

Mr. Bourne then moved for ... adopting or

rejecting the federal government - which

was seconded by Gov. Bowen.

The quest. being then put at 20 minutes

past five p.m. it passed in the

affirmative - thirty four members voting

for the adoption and thirty two

against it....

In my opinion, this same act of ratifying

the constitution immediately gave birth to the new state, as their law of the

land became the same of the previous 12 states.

Best wishes,

Jorge

RE: Re: OHIO

rectified chart: " YES, OF COURSE "

Hi

Jorge,

Perfect solution. By the way, as in

this instance the very same language was used in the act to admit Rhode

Island, on June 14, 1790.

Journal of the Senate of the United States of America,

1789-1873

SATURDAY, FEBRUARY 19, 1803.

" Mr. President: The President of the United States

did, this day, approve and sign " An act to provide for the due

execution of the laws of the United States within the state of Ohio. "

Here's what 19th century scholar, Alexander Johnson, wrote

in Lalor's Cyclopedia, 140 years ago:

The act of Feb. 19, 1803 . . . declared that Ohio, by

the formation of its constitution in pursuance of the act of April 30, 1802,

" has become one of the United States of America, " and provided for

the extension of federal laws to the new state. . . . if the precedents in

the case of the admitting acts of all other new states are to govern this

case, Ohio as a state dates from the act of Feb. 19, 1803. [ His

hestitation, of course, touches on the matter of the later alternative date of

March 3rd.]

An earthquake on June 18, 1875, caused damage in western Ohio, and

affected a total area estimated at 104,000 square kilometers.

Several towns in southeastern Ohio experienced moderate damage on

November 5, 1926.

A brief but strong shock was felt over a wide area in western Ohio

on September 30, 1930. Less than one year later (September 20, 1931), another

damaging earthquake occurred in the same area.

On March 2, 1937, much additional damage occurred at Anna.

The next day, March 3, at 3:50 a.m., a moderate earthquake

(intensity V) shook the same area. It awakened many persons, rattled windows,

and shook some bricks from chimneys.

The strongest tremor of this series occurred at 11:45 p.m., March

8, 1937.

On March 9, 1943, an earthquake centered east of Cleveland, was

felt over a 100,000 square kilometer area, but only caused minor damage at

points nearest the epicenter.

On June 20, 1952, an early morning (3:38 a.m.) tremor awoke most of

the people in the Zanesville area.

A Speculation:

The Congressional Staff

who did the " foot work " in preparing the 1953 legislation confused

March 1st, the date the bill passed the House (and where the bill

originated) with the date of Completion, which is the date of

enactment, by the President's signature of March 3rd.

SUBJECT: March 3,1803 not March 1, 1803

1953: August 7th: It all started in 1953 when Ohio was preparing to

celebrate the 150th anniversary of its admission to the Union.

Researchers looking for the original statehood documents discovered

there'd been a little oversight. While Congress had approved Ohio's

boundaries and constitution, the State retained no official record of

notification to the State of Ohio authorities. Many " Buckeyes " feared

that technically, therefore, Ohio was not a duly admitted State.

Ohio congressman George Bender wanted to remedy this embarrassment

and so introduced a bill in Congress to " finalize " the admittance of

Ohio to the Union, retroactive to the relevant Act in 1803. They

chose " March 1 " , 1803. At a special session at the old state capital

in Chillicothe the Ohio state legislature approved a new petition for

statehood that was delivered to Washington on horseback [ " I'm not

making this up " ]. Congress subsequently passed a joint resolution,

and President Eisenhower signed it on August 7, 1953. Trouble is they

chose the wrong date, wrong by 2 days. In 1803 President Jefferson

had signed the act of admittance on March the 3rd, not March the

1st.

1803: March 03rd: Ohio becomes the Seventeenth State to join the

Federal Government. On this day, in the afternoon, President Thomas

Jefferson did approve and sign " An act in addition to, and in

modification of, the propositions contained in the act, entitled 'An

act to enable the People of the Eastern division of the Territory

Northwest of the river Ohio, to form a Constitution and State

Government, and for the admission of such State into the Union, on an

equal footing with the original States; and for other purposes; "

1802:

November 29th: A convention at Chillicothe, Nov. 1-29, formed

and adopted the State of Ohio's first constitution, which went into

legal force without submission to popular vote.

1802, April 30th: Federal enabling act signed by President Jefferson

this day; pursuant to the Northwest Ordinance of July 13,1787 and the

Ohio Act of Petition of December 21, 1801. Ohio is henceforth

recognized as a territorial State in the process of forming a

constitution and government.

1801, December 21st: An act declaring the assent of the Territory

Northwest of the river Ohio to an alteration in the ordinance for the

government thereof is voted this day; Ohio as a State empowered by

this " original compact " is born of this event.

Journal of the House of Representatives of the United States, 1801-

1804

THURSDAY, MARCH 3, 1803--SIX O'CLOCK, P. M.

A message was received from the President of the United States, by

Mr. Lewis, his Secretary, notifying that the President did approve

and sign, this day, an act, which originated in this House, entitled:

" An act in addition to, and in modification of, the propositions

contained in the act, entitled 'An act to enable the People of the

Eastern division of the Territory Northwest of the river Ohio, to

form a Constitution and State Government, and for the admission of

such State into the Union, on an equal footing with the original

States; and for other purposes. "

Statute I.

Act of August 7, 1789, ch. 8.

Act of May 8, 1792, ch. 42.

The inhabitants of the eastern division of the territory west of the

Ohio to form a constitution and become a state.

Act of March 3, 1803, ch. 21.

Boundaries thereof.

Act of February 19, 1803, ch. 7.

Act of July 14, 1832, ch. 240.

Act of June 15, 1836, ch. 98.

Hi Jorge Quite right about Rhode Island ....."For ratifications" However, that's only half the story: meaning, ratification before admittance. As I pointed out in a long ago post here. One must be careful to distinguish between the event of Ratification and the event of Admittance. Ratification is Constitution determined; Admittance is Government determined. The First 13 States ratified on various dates: The First 10 [latest, Virginia on June 25th] were part of the act of the Constitution's establishment on July 2, 1788 [and Yes, I know: New Hampshire first made the minimum threshhold of "9" on the 21st ]. New York's ratification on July 26th made 11, which 11 were "effectively admitted" to the Federal Government on the day of this government's establishment, on September 13,1788. I write "effectively" because there was no

Federal Government before September 13th; however in its infancy soon after, as Congressional elections were the first events scheduled starting later that very same month. After New York the two events, the Constitution-not-to-be-confused-with-Government events, and their real distinction, became straight forward to observe: i.e., Ratification event followed by Admittance event: Witness: North Carolina, the 12th: December 21, 1789 & February 8, 1790 Rhode Island, the13th: May 29, 1790 & June14,1790 Vermont, the14th: January 10, 1791 & March 4, 1791 Kentucky, the 15th: April 19, 1792 & June 1, 1792 Tennessee, the 16th: February 6, 1796 & June 1,1796 Ohio, the 17th: November 29, 1802 & February 19, 1803 Louisiana, the 18th: January 22, 1812 & April 8, 1812 And so on. Cheers Jorge Angelino <jorge.angelino wrote: Dear John, As you know, RI was the last of the 13 original colonies to ratify the Constitution. They did it on Saturday, May 29th, 1790. Regarding their TOB, I received this answer to my query on RI: Mr. Angelino, The RI vote occurred at 5:20 p.m., Saturday, May 29th, 1790. The journal of the convention relating to same reads as follows: "Saturday, May 29th, 1790 -- Mr. Bourne then moved for ... adopting or rejecting the federal government - which was seconded by Gov. Bowen. The quest. being then put at 20 minutes past five p.m. it passed in the affirmative - thirty four members voting for the adoption and thirty two against it.... Kenneth S. Carlson Reference Archivist Ken Carlson [kcarlson] In my opinion, this same act of ratifying the constitution immediately gave birth to the new state, as their law of the land became the same of the previous 12 states. Best wishes, Jorge SAMVA [sAMVA ] On Behalf Of JohnTWBsexta-feira, 12 de Maio de 2006 00:47SAMVA Subject: RE: Re: OHIO rectified chart: "YES, OF COURSE" Hi Jorge, Perfect solution. 19, 1803 . . . declared that Ohio, by the formation of its constitution in pursuance of the act of April 30, 1802, "has become one of the United States of America," and provided for the extension of federal laws to the new state. .

.. . if the precedents in the case of the admitting acts of all other new states are to govern this case, Ohio as a state dates from the act of Feb. 19, 1803. [ His hestitation, of course, touches on the matter of the later alternative date of March 3rd.] Jorge Angelino <jorge.angelino wrote: Dear John, Thank you for bringing this to my attention. Several towns in southeastern Ohio experienced moderate damage on November 5, 1926. A brief but strong shock was felt over a wide area in western Ohio on September 30, 1930. Less than one year later (September 20, 1931), another damaging earthquake occurred in the same area. On March 2, 1937, much additional damage occurred at Anna. The next day, March 3, at 3:50 a.m., a moderate earthquake (intensity V) shook the same area. It awakened many persons, rattled windows, and shook some bricks from chimneys. The strongest tremor of this series occurred at 11:45 p.m., March 8, 1937. On March 9, 1943, an earthquake centered east of Cleveland, was felt over a 100,000 square kilometer area, but only caused minor damage at points nearest the epicenter. Govt wrong by 2 days] A Speculation: The Congressional Staff who did the "foot work" in preparing the 1953 legislation confused March 1st, the date the bill passed the House (and where the bill originated) with the date of Completion, which is the date of enactment, by the President's signature of March 3rd.JohnTWB <first_july_1776 wrote: SUBJECT: March 3,1803 not March 1, 18031953: August 7th: It all started in 1953 when Ohio was preparing to celebrate the 150th anniversary of its admission to the Union. Researchers looking for the original statehood documents discovered there'd been a little oversight. While Congress had approved Ohio's boundaries and constitution, the State retained no official record of notification to the State of Ohio authorities. Many "Buckeyes" feared that technically, therefore, Ohio was not a duly admitted State. Ohio congressman George Bender wanted to remedy this

embarrassment and so introduced a bill in Congress to "finalize" the admittance of Ohio to the Union, retroactive to the relevant Act in 1803. They chose "March 1", 1803. At a special session at the old state capital in Chillicothe the Ohio state legislature approved a new petition for statehood that was delivered to Washington on horseback ["I'm not making this up"]. Congress subsequently passed a joint resolution, and President Eisenhower signed it on August 7, 1953. Trouble is they chose the wrong date, wrong by 2 days. In 1803 President Jefferson had signed the act of admittance on March the 3rd, not March the 1st. 1803: March 03rd: Ohio becomes the Seventeenth State to join the Federal Government. On this day, in the afternoon, President Thomas Jefferson did approve and sign "An act in addition to, and in modification of, the propositions contained in the act, entitled 'An act to enable

the People of the Eastern division of the Territory Northwest of the river Ohio, to form a Constitution and State Government, and for the admission of such State into the Union, on an equal footing with the original States; and for other purposes;" 1802: November 29th: A convention at Chillicothe, Nov. 1-29, formed and adopted the State of Ohio's first constitution, which went into legal force without submission to popular vote. 1802, April 30th: Federal enabling act signed by President Jefferson

this day; pursuant to the Northwest Ordinance of July 13,1787 and the Ohio Act of Petition of December 21, 1801. RE: Re: OHIO

rectified chart: " YES, OF COURSE "

Hi Jorge

Quite right about

Rhode Island ..... " For ratifications "

However, that's only half

the story: meaning, ratification before admittance. As I pointed out in a long

ago post here. One must be careful to distinguish between the event of

Ratification and the event of Admittance. Ratification is Constitution

determined; Admittance is Government determined.

The First 13 States

ratified on various dates: The First 10 [latest, Virginia on June

25th] were part of the act of the Constitution's establishment on July 2,

1788 [and Yes, I know: New Hampshire first made the minimum threshhold of

" 9 " on the 21st ]. New York's ratification on July 26th made 11,

which 11 were " effectively admitted " to the Federal Government on the

day of this government's establishment, on September 13,1788. I

write " effectively " because there was no Federal Government before

September 13th; however in its infancy soon after, as Congressional

elections were the first events scheduled starting later that very same month.

After New York the two

events, the Constitution-not-to-be-confused-with-Government events, and their

real distinction, became straight forward to observe: i.e.,

Ratification event followed by Admittance event:

Witness:

North Carolina, the

12th: December 21, 1789 & February 8, 1790

Rhode Island,

the13th: May 29, 1790 & June14,1790

Vermont, the14th:

January 10, 1791 & March 4, 1791

Kentucky, the 15th:

April 19, 1792 & June 1, 1792

Tennessee, the

16th: February 6, 1796 & June 1,1796

Ohio, the 17th:

November 29, 1802 & February 19, 1803

Louisiana, the

18th: January 22, 1812 & April 8, 1812

And so on.

Cheers

Regarding

their TOB, I received this answer to my query on RI:

Mr.

Angelino,

The

RI vote occurred at 5:20 p.m., Saturday, May 29th, 1790. The

journal

of the convention relating to same reads as follows: " Saturday, May 29th,

1790 --Â Mr. Bourne then moved for ... adopting or

rejecting

the federal government - which was seconded by Gov. Bowen.Â

The

quest. being then put at 20 minutes past five p.m. it passed in the

affirmative

- thirty four members voting for the adoption and thirty two

against

it....

In my

opinion, this same act of ratifying the constitution immediately gave birth to

the new state, as their law of the land became the same of the previous 12

states.

Best

wishes,

RE: Re: OHIO

rectified chart: " YES, OF COURSE "

Hi

Jorge,

Perfect

solution. By the way, as in this instance the very same language was used

in the act to admit Rhode Island, on June 14, 1790.

March 3rd.]

A brief but strong shock was felt over a wide area in western Ohio

on September 30, 1930. Less than one year later (September 20, 1931), another

damaging earthquake occurred in the same area.

On March 2, 1937, much additional damage occurred at Anna.

Act of August 7, 1789, ch. 8.

Act of May 8, 1792, ch. 42.

The inhabitants of the eastern division of the territory west of the

Ohio to form a constitution and become a state.

Act of March 3, 1803, ch. 21.
