Ce décret précise, en outre, la voie à suivre pour donner au nouvel Etat un régime constitutionnel : Elaboration d'un projet de Constitution par un Comité central. Convocation d'un Congrès national (où sont représentés tous les intérêts des provinces) pour examiner le projet de Constitution et le rendre exécutoire sur tout le territoire comme Constitution définitive. Par un arrêté du 11 octobre 1830, le Gouvernement provisoire fixe les modalités de l'élection du Congrès national prévue le 3 novembre. Le Congrès national se réunit pour la première fois le 10 novembre 1830 au Palais des Etats généraux de Bruxelles sous la présidence du doyen d'âge M. J-F. Gendebien. Le 18 novembre, il proclame à l'unanimité l'indépendance du peuple belge, sanctionnant ainsi le décret du 4 octobre 1830.
