Dear Respected of the masters,

must let you know since my last corrospondence with you and i thank

you again~~ now i have found out that having been going prosa on my

own on mothers wrongful death suit aginst the administration of the

icu unit where you know they left her untied and she was alarming for

the plea for her life as her trach came loose. No one came to her aid

for over 8 minutes and in reality mother was gone for more than 10-12

minutes. any way you have answered most of my questions as well as

your students and I thank you so much for being here for me again ,

 

my question is very very important to me as time now is coming up to

when i have to be in court on march 2 2007 at 9:30am central time in

new orleans la. Well since i have been going prosa for me and my

parents grandchildren meaning that my brothers widow is also in on

this wiht me. Well after talking to lawyers after lawyers they have

not been able to take on mothers case due to their conflict of

interest they have has to the hosptital i am suing becasue either they

have family members that work there or they have them also as their

clients. Now let me let you know what happend with this one lawyer

who happens to be a trial lawyer whom i talk to over a month ago he

told me yes he would take on the case but to retain him it would cost

10,000.00 dollars but he explained to me the difference between just a

lawyer of law vs a trial lawyer in which he is. He said i would have

to effentually have to have a trial lawyer no matter what so i said i

would get back to him if i needed him. Well after i sent my the

defentants demand for production of documemts which included all

mothers medical files and not excluding the telemtry report as well as

wanting to know where the icu staff of the event mother flatlined on

sept 23rd 1999 at 7:pm-7:30pm where they all are now! now the judge

gave us both 15 days to answer all motions in a proper and timely

fashion with no excuses!! well i have done what was asked by them as

to follow the court and judges rules. I asked for him to answer these

questions and to send all mothers medical files back in dec, well i

waited more then the 15 days i waited a month then i got back to him

and ask him why hasnt he sent me mothers medical files he said whats

your hurry I said John, you and i know how fast time goes now I want

all mothers medical files and he said ok but it will take me atleast a

week to get them out to you that was now for the 2nd time of me asking

him and now 2 weeks ago with still no medical files on mother from him

so i contacted him and told him my next step would be to complain to

the judge and to certify a letter to him as well how he has not

performed his duties as the judge requested. his response was oh well

do what you have to do then he hung up on me, well at that point i

called the hosptial talked to medical records not the same persons he

was dealing with because of so many files missing on mother and john

the opposing lawyer told me i have your mothers files and there with

me and i will send them to you asap that was back before i requested

tethem in the correct manner by the courts and as of the date mother

flatined he only had 999 files on mothers medical records and still

told me after our last converstation that all the files he has on

mother to send me we all her medical files and there were 999 pages

and thats all there are. anyway after that last converstaion when he

hung up with me i contacted medical files at hosptial as mentioned

above and talked to another person and explained what happened to my

mother and told her i have to have my mothers medical files and he

told me there were only 999 pages. I also ask if she would please not

say a word as this is my mother and what if it were her mother or kids

and whom i am up against she said she knew as this lawyer is always up

here in medical files and knows what a beast he can be, so she in that

same day got all mothers files sent them off to me when she told me

she found mothers medical files there were 1079 files all together i

was amazed, when i got the files by fedex i could not believe my eyes

the box had been torn open and i called her asap and asked her how she

wraped the box she told me taped all around the box and that there

would be no way anyone could get into them as securly as she taped

them. i took a picutre of the box and reported to fedex as well as

calling the mail room of the hosptial to see who had opened the box

the man i talked to said of course in a shakey voice no one, so i took

it at that but still am today writing a letter to the judge as to how

he has not responded by her demands as to get all motions out in a 15

day process since this case of my mothers has gone on way to long, in

every time i have been in court since sept 8th 2006 the honorable

judge has always said to me your going to have to get your self a

lawyer its very important and i told her i have been trying ! Well

this last time we appeared my baby brothers widow and myself, she said

again ms.macfadden you must have a lawyer present when you come back

here in court on march 2 2007. Now i know the importance and now have

tried harder and harder, so i remembered talking to this trial lawyer

who told me he would take on the case as i would need a trial lawyer

anyway so like i mentioned above to you as i mentioned to him for

10,000. dollars thats a lot of monies i would have to look around and

he said sure he understood but, if i need him he will be there for me.

now i need him as i am finding out after 4 lawyers i have gone to they

would not take on the case as there was a conflict of interest

involving family members that work at the hosptial and so on, so now i

had no other choice to call him yesterday and we made an appointment

for the 13th of this month. So now i have called my brothers widow to

tell her we have to hire this trial lawyer she never got back to me so

i called her father to let him know the same thing and he told me that

suzy my brothers widow that was keeping 10,000.00 dollars in a savings

just in case of something like this in case we needed, well her father

old me that suzy my brothers widow has decided to withdrawl from the

case like my bad brohter did, his reason was if you have to pay

10,000.00 dollars on a lawyer than thats a sign you have a losing

battle so she will probably withdrawl,now here we are talking about me

going prosa all this time and making sure she is in on it as she is my

brothers wife and he has 4 heirs of his own his children my mothers

grandchildren and if my brother did not die he would be with me all

the way on this. So now i am finding myself having to go it all alone

now how bad this must look to the courts on me as to have her

withdrawl now, as the oppossing side could now put her on the stand

and ask her why she has withdrawn from the case and her resonse would

be because of the monies if i had to come up with 10.000 dollars then

i am looking at losing my 10,000.00 dollars for what i see then would

be a lose lawsuite! i cant even imagine what she would say but i do

no what and how bad this now looks on me as to have my living bad

brother withdrwal but now my brothers widow, so now i need this

lawyer and i am going to have to come up with the 10,000.00 dollars

myself my means of asking for a loan and pray i get it so this lawyer

can put his name on the case and take over as my trial lawyer aginst

one of the most aggressive lawfirms in the country. I am going to ask

this wonderful friend of mine who has helped me in the past before and

i hate to do this as i am having to pay so much on these two cases i

have going one with my brother and the biggest one is my mother, I

know i will win as the Master has already made that perfectly clear to

me as well as his students and not to ask the same question over and

over so i have done just that. but now my question is this with all

the trouble that this opposing lawyer is giving me is because he knows

i still dont have a laywer so he fills once i get into court on march

2nd i will not have a lawyer. my question will my sister in law have

second thoughts this weekend and by next week decide not to drop out

and use the 10,000.00 dollars and go all the way with me on this? and

will i get the loan from my freind as i will have me along with my

other half go in on this with me to pay her back?

by the way that 10,000.00 dollars that my brothers widow has is really

part of my monies what my older brother stole from me but she does not

know i know any of this as my lawyer in my parents estate are keeping

quiet until we get to court so i can regain my inheritance back as

well as the house i pray. and in the meantime i am trying to buy a

home now so that when the house of my parents is given back to me that

what i would do would sell the house i am trying to buy or let my son

and his family live in it and pay the mortage if not sell it make a

profit and move back into my parents home. Back to mother, I talked

with mothers doctor yesterday as we go to the same church and he had

my mother as a patient for more than 25 yrs I ask him if he would be

so kind as to look at mothers medical files and give me his opion on

wht he felt went wrong and the whys of why did the icu not follow

protocall. he said he would do so with out cost this is another winner

for me as the judge also said to have proper expert witness on march

2nd either in writing or there well be no other way for her to go but

to go with the defendents in their favor, so you see i had to hire

this trial lawyer its just how am i going to come up with the money by

by friend who was born 7/27/30 or by my sister in law widow of my

asking as so many issues are going on in my life as it can be very
