Rajesh, I'm not about to sit in judgment on whether or not you're a lurking

monster. That said, having been raised in the presently prevalent sociological

Indian clime, commonsense tells me that it's quite unlikely that sane adults

will entice their daughters from marriage and scuttle it without good reason or

for ulterior motives. I readily concede that it doesn't take much for a marriage

to flop but in your case, a divorce isn't all that's being asked for. Just for

those that don't know it, here's Section 498(a) of the Indian Penal Code:

498A. Husband or relative of husband of a woman subjecting her to

crueltyWhoever, being the husband or the relative of the husband of a woman,

subjects such woman to cruelty shall be punished with imprisonment for a term

which may extend to three years and shall also be liable to fine.

Explanation- For the purpose of this section, "cruelty" means-

(a) any wilful conduct which is of such a nature as is likely to drive the woman

to commit suicide or to cause grave injury or danger to life, limb or health

(whether mental or physical) of the woman; or

(b) harassment of the woman where such harassment is with a view to coercing her

or any person related to her to meet any unlawful demand for any property or

valuable security or is on account of failure by her or any person related to

her to meet such demand.]

A divorce can easily be filed (and obtained) on grounds of incompatibility

alone; no frills needed at all. Why the heck then is a complaint under 498A

being lodged?

I was married on 26th January 2000 but it is not successful. We stayed for a

very short period. Finally, we moved apart in June 2001.

My in-laws have made false allegations and are harrassing us for last 3.5 years.

They registered a false case under 498(A) in Bombay and a divorce case in

Calcutta.
