Supreme Court rejects death for child rape

Ruling states execution would violate ban on cruel and unusual punishment

WASHINGTON - The U.S. Supreme Court on Wednesday struck down a state law that allows the execution of people convicted of a raping a child.

In a 5-4 vote, the court said the law allowing the death penalty to be imposed in cases of child rape violates the U.S. Constitution's ban on cruel and unusual punishment.

"The death penalty is not a proportional punishment for the rape of a child," Justice Anthony Kennedy wrote in his majority opinion. His four liberal colleagues joined him, while the four more conservative justices dissented.

There has not been an execution in the <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com><st1:State w:st=<st1:place w:st=" />United States for a crime that did not also involve the death of the victim in 44 years.

Bhaktajan's comment:

Capital Punishment/Death Penalty/Execution —should be something that the guilty person should, ask for, request, demand, expect, be satisfied with, and, be thankful for.

Execution for rape & homicide for those whose crimes/guilt are known and documented on live television is the most merciful treatment for such sinful behavior.

The criminal should not be allowed to accrue anymore sins, even as small as killing an insect. This is the best thing for redeeming the proper mind-set of the executed guilty party.

Agreed. The Supreme Court is out of whack. Another 5 to 4 vote with the liberals having the five. These are the same five that recently gave the green light to cities taking private land and homes from people and giving it to private developers who will bring in more tax money for the city.

In this case the Supremes showed their total ignorance as to what constitutes life. They are reluctant to extinquish life not knowing that is not even possible.

A society that does not have aham brahmasmi as a foundational understanding has no chance of making correct decisions in such situations other than by accidentally getting it right but for all the wrong reasons i.e. death penalty being apllied out of pure revenge and hatred rather than the common good for society and the offender.

And these nine are supposed to represented the wisest in the land.
